Be advised that there have been no changes to the documents from the 2015 agreements except for the updating of dates. Secondly, please find attached the Water Bugs Ski Team practice and show dates document. The Water Bugs are requesting one less practice date and one less show date than in 2015. There were no complaints recorded in 2015. Recommendation for Action by Committee: I suggest both the pier placement and ski jump placement agreements are passed due to no changes to past agreements. I also suggest we approve the show dates and practice dates for 2016. AGREEMENT WATER BUGS SKI TEAM, INC. and CITY OF MUSKEGO THIS AGREEMENT is made by and between the Water Bugs Ski Team, Inc., a Wisconsin corporation, hereafter referred to as “the Corporation,” and the City of Muskego, hereafter referred to as “the City.” WHEREAS, the Corporation understands it is necessary for the Corporation to obtain appropriate approvals from the Wisconsin Department of Natural Resources, hereafter referred to as “the WDNR,” to place a water ski jump on the bed of Little Muskego Lake; and WHEREAS, the City’s approval of the placement of said ski jump is conditioned upon the execution of this Agreement, NOW, THERERFORE, in exchange for the execution of this Agreement and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Corporation and the City agree as follows: 1. Term of Agreement. a. The term of this Agreement shall commence on the date on which the Corporation obtains all required approvals from all governing bodies and agencies, including, but not limited to, the WDNR, for placement of a water ski jump on the bed of Little Muskego Lake. The Corporation shall provide the City copies of all approvals obtained by the Corporation under this Agreement. Unless earlier terminated by action of the City, the term of this Agreement shall terminate on the 30th day of September, 2016. b. The term of this Agreement shall automatically terminate in the event the Corporation is properly ordered or otherwise required to remove the water ski jump from the bed of Little Muskego Lake by any governmental authority or agency. c. Upon termination of this Agreement, the Corporation shall remove the ski jump from the bed of the lake, together with any related equipment and materials, within seven (7) calendar days or no later than September 30, 2016. 2016 Agreement – Regarding Ski Jump Page 2 Water Bugs Ski Team, Inc. and City of Muskego 2. Ownership and Placement of Ski Jump. a. At all times during the term of this Agreement, the Corporation shall be the sole owner of the ski jump located at Idle Isle Park, W182 S6666 Hardtke Drive, and PT NE ¼ of SEC 8T5N R20E & PT NW ¼ SEC 9 AN ISLAND APPROX 1100 FT N OF SE COR OF NE ¼ CONT 500 SQ FT VOL 1204/699 DS 3858687 QCD 9/11, in the City of Muskego. The Corporation cannot, without the prior written approval of the City, assign any ownership interests in the ski jump or any of the Corporation’s rights, duties or obligations under this Agreement to any person, entity or association. b. The Corporation shall be responsible for the physical placing and removal of the ski jump on and from the bed of Little Muskego Lake. The physical location of the ski jump on the bed of the lake shall be subject to the direction and decision of the City. c. While the ski jump is on the bed of the lake, the Corporation shall cause the installation, maintenance and operation of a flashing yellow light on the ski jump, from dusk to dawn. The flashing yellow light must be visible for at least 500 feet in all directions. d. The Corporation shall be solely responsible for and shall promptly perform all maintenance and upkeep required or recommended for the ski jump. In the event the Corporation fails, at any time, to perform any maintenance or upkeep reasonably deem necessary by the City, upon written notice to the Corporation, the term of this Agreement shall immediately terminate. 3. Liability Matters. a. The Corporation shall indemnify the City and hold the City harmless against and from any and all liabilities, fines, suits, claims, demands and actions, including costs and expenses of any kind or nature, including, but not limited to, attorneys’ fees, brought or asserted by anyone due to or arising out of (a) any default by the Corporation in observing any provision of this Agreement required to be observed and performed by the Corporation, or (b) any damage to property or injury to person or persons, including death, occasioned by or resulting from the Corporation’s ski jump. b. During the term of this Agreement, the Corporation, at its expense, shall maintain comprehensive general liability coverage, bodily injury coverage, and property damage coverage, insuring the Corporation and the City against liability for injury to persons or property occurring on or about the ski jump or arising out of the ownership, maintenance, or use of the ski jump. The insurance shall have a limit of not less than $1,000,000 per occurrence with an aggregate limit of not less than $2,000,000. Notices. a. NOW, THEREFORE, in exchange for the execution of this Agreement and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Corporation and the City agree as follows: 1. The physical location of the pier shall be placed at a distance of thirty (30) feet from the 5' x 32' pier abutting the boat landing (see Exhibit A) having a maximum length of thirty (30) feet. C. The Corporation will allow the City and the public to use this pier at all times that it is not scheduled for exclusive use of the Corporation. The Corporation will make five signs, with prior approval of the Recreation Manager. Two signs will indicate that the swimming area will be decreased in size ten minutes prior to and throughout the practice/show times as posted on the beach and at the entrance of the park. The swimming area will be increased to its original size ten minutes after the show or practice time unless in the case of a cancelled show or practice. The other two signs will indicate that the pier will be closed to the public one-half hour prior to and throughout the practice/show times posted at the pier and at the entrance of the park. The pier will be open to the public one-half hour after the show or practice time unless in the case of a cancelled show or practice. The last sign will indicate that the Corporation’s pier is not to be used for public swimming, diving or jumping from and no public boats shall be docked/moored to said pier. D. The Corporation shall be solely responsible for and shall promptly perform all maintenance and upkeep required or recommended for the pier and signs. In the event the Corporation fails at any time to perform any maintenance or upkeep reasonably deemed necessary by the City, upon written notice to the Corporation the term of this Agreement shall immediately terminate. 3. The request is for 7:00 a.m. to 8:00 p.m., however it has been indicated that is the time they will arrive on 8/22 to the time the leave on 8/30. Park hours are asking to be extended to 11:30PM. Also, attached is an email outlining information on parking plans with the anticipated construction at city hall. Recommendation for Action by Committee: Recommend approval of the event with the following conditions: 1. Park Rental fee is waived for the dates of August 24-September 1. 2. Park hours are approved to extend to 11:30 p.m. on the nights of the festival: August 27, 28, 29 and 30. 3. The Festival Committee will be utilizing an outside contractor to provide any grounds maintenance needed prior to and at the conclusion of the event. Please see email attached from Dave Simpson. 4. Renter would secure event insurance listing City of Muskego as an additional insured with the dates of the event being from the day carnival vendors arrive until August 30 when all festival items are gone. 5. Renter will have a dumpster placed alongside the parking lot on Pioneer Drive. Said dumpster would be removed promptly by August 30 or daily park rental fees will be charge to the festival committee until the dumpster is removed. 6. Discussion will take place in August in regards to alternate parking options for the areas around city hall as construction begins. 7. Beer permits for the park as well as a liquor license will be secured no later than August 12. This is to cover the carnival vendors on city grounds up to the start of the festival (8/22-8/30). Once a copy of the selling of beer permit is received from the City, please forward on a copy to the Recreation office to be placed with your rental documents. 8. Carnival vendors who will be camping on park grounds, it is suggested that they park all recreational vehicles and those vehicles used to tow the carnival rides on Page 2 of 2 the asphalt areas of Old Town Hall. It is recommended that all heavy equipment is kept off the wet area off the tree lined area bordering the park. 9. The city will have the restrooms cleaned on August 21 after our rental and then locked to the public. Restrooms will not be opened for carnival vendors. If park users wish to use restrooms during the week leading up to the festival, they will be able to access city hall during normal business hours, or if a festival committee member is available, they can open the restroom for the resident. Festival staff will make sure the restrooms are kept clean daily (including making sure all toilets are flushed, paper products & hand soap are available and that the restrooms are clean.) 10. Carnival vendors may not run hoses or power cords from Veterans Park Shelter for hook-up for the personal water or electric. It is understood there is a need to run water from the shelter to the shower facility for the carnival vendors. This hose will be secured and taped down as it crosses over the paths to reduce the risk of injury to park users. 11. Carnival vendors will be instructed prior to their arrival that there are no dogs allowed in city parks and that includes the time they are on site overnight. Please find attached staff’s assessments for the areas noted above. Take some time to think about the assessments we have completed and come prepared with your own notes about what future needs you may see in our parks. Items can be related to maintenance, recreation, landscaping, and more. Park Plan As discussed at our last meeting staff is prepared to present the first working draft of the Park Plan that includes the various ways we intend to present the park assessments and resulting recommendations. Staff will bring hard copies of the plan to the meeting. Staff intends to briefly go over the hard copy and would like the Committee to review the draft over the next months. to Parks maintenance for your use. Should any questions arise please don’t hesitate to contact me directly. Maintenance Items  Fox Services LLC has completed Lawn Mowing and Grounds Maintenance for the contracted parks and certain facilities for 2015. They have agreed to keep prices the same for 2016 so we will extend the contract one more year.  Vandalism occurred at Park Arthur at least twice this winter. We were able to collect a settlement of around $4,000 from one offender and the P.D. is looking into leads on one of the other incidents now.  We have ordered four new floats for the boat launch piers at Idle Isle. They were taking on water last season so we will put the new floats on and have the piers in shorty. All other piers are in on Little Muskego, with Big Muskego to follow as soon as all the bogs are removed. Facilities  Horn Park Building- All work is completed except for painting the building, which the DPW will do this Spring as time allows.  Shingles blew off of the shelter at Denoon, so we will be making repairs. 2016 Park Improvements  Park Arthur- The fencing of the three small fields’ outfields and their dugouts is completed. DPW will finalize grading and moving of the bleachers in the Spring.  Bluhm Park- The Developer of Belle Chasse Subdivision has completed the boardwalk improvement, Rugby field and walkway from Durham Drive to the Park. The field will likely be ready for play no earlier than the fall of 2016 or spring of 2017.  WE Energies Trail Improvement- The City retained all asphalt millings as part of the 2014 and 2015 road improvement programs in order to utilize them to construct and repair gravel recreational pathways with a very low material cost. We have since had the company that crushed the material for us crush the material into smaller size aggregate so that the material will compact better we will overlay a 2” layer on the larger stone, hopefully in the Page 2 of 2 Spring of 2016. We can then analyze whether this size aggregate will work for all future needs or not.  Sand Hill Park- Bids came back favorably, so the Common Council awarded all alternates, including the parking lot and pathways, with the total estimated cost to be about $234,000. The upgrade to athletic seed mix ($2,000) will be paid for by the Kickers. Memo To: Parks and Conservation Committee From: Tom Zagar CC: Jeff Muenkel Date: March 23, 2016 Re: Conservation Coordinator Report Here is an update of projects related to Lakes, Forestry, and Conservation: · Floating mats of cattails (referred to as “bogs”) is a randomly recurring situation on Big Muskego Lake. High wind causes cattail bogs to uproot and travel to new locations in the lake – often impeding access and navigation. City crews recently removed several truckloads that had accumulated and blocked the Durham launch. A 3-acre bog has blocked the entrance of the channel that leads to the residences on Holz Drive. Citizens there are attempting to cut it apart and hope that easterly winds will blow this bog away from the channel entrance. My assistant and I often use the Big Muskego Lake District boat to push nuisance bogs to open navigation. In some years this can amount to a considerable amount of time. We will examine the idea of charging the Lake District’s budget for this service if an inordinate amount of time is expended. · Plans are underway for an Eagle Scout tree planting project at Denoon Park by Nick Buske. Twenty- five coniferous trees will be planted as a wind break around the basketball court. · Staff has applied for DNR permits to install a pedestrian bridge at Badertscher Preserve. Nick Johnson will construct the bridge as an Eagle Scout project. · Wachtel Tree Sciences Incorporated will conduct staff training for the city tree crew on April 12 & 13 with costs covered by a DNR grant. · Prescribed burning is a helpful tool in management of native vegetation. Thus far controlled burns have been conducted at Kurth Park, Luther Parker Cemetery, and Engel Conservation Area. The number of burns will depend on weather but the season is concluded by the end of April as vegetation greens up. Community Development Department CITY OF MUSKEGO Staff Report to Parks & Conservation Committee April 6, 2016 To: Parks & Conservation Committee From: Tammy Dunn, Recreation Manager Subject: Recreation Program Miscellaneous Updates Date: March 22, 2016 Please find the following items in relation to various recreation programs/activities in the city. Such items don’t require committee action but can certainly be discussed during the Miscellaneous Business portion of the meeting. 1. We have been working with a new vendor for the softball/baseball field scheduling component. We are now in the testing phase and plan to have it active for the user groups by early April. We have not yet released the fields for playing yet, so we have the time to test the software for several days to make sure it meets the needs of our user groups. The vendor is eCity, which the city is also using for bill payment. They have created this particular program just for our needs. It will be very similar to what we have had in the past, but will have some upgraded features including an email confirmation of the scheduled practice, so that people can show that to any group on the field that shouldn’t be there. 2. We are now working on our Summer Program Guide. Guides are scheduled to be mailed in mid-April. Several new programs are being introduced including a softball league for adults ages 55+ and a Big Muskego Kayaking trip led by our own staff. 3. We are again approving the Cigno Dental’s request to hold their Annual Patient Appreciation event at Idle Isle for July 20th or July 27th during the Water Bug show. We have allowed this use for the past few years.
