CITY OF MUSKEGO Staff Report to Public Works Committee To: Public Works Committee From: David Simpson, P.E., Director of Public Works/City Engineer Subject: Review Refuse/Recycle collection proposals for the 2016-2020 program cycle Date: September 17, 2015 Proposals were received on August 27th, 2015 for the collection and hauling of refuse and recycling for the years 2016-2020 for the City of Muskego. Two companies submitted proposals with costs and all are attached for your review. Our current vendor, Advanced Waste was the resulting low bidder and has served the City well for quite some time now. The low bids are shown on the attached proposal with a summary as follows:  Cost for Manual Collection= $4.45/HH/Month x 9370HH = $41,696.50/month  Cost for Automated Collection= $4.23/HH/Month x 9370 HH/Month= $39,635.10 + Cart Costs of $0.38 to $0.44 per HH/Month (equals $3,560.60 to $4,122.80/ month) depending on cart size for a total cost of $43,195.70 to $43,757.90/month.  Cost for Recycling Collection for Contractor Retained= $1.98/HH/Month x 9370HH= $18,552.60/month + cart cost of $0.38/HH = $22,113.20/month  Cost for Recycling Collection with delivery to Waukesha County facility= $2.08/HH/Month x 9370HH= $19,489.60/month + cart cost of $0.38/HH = $23,050.20/month  Cost to run the yard waste drop off site= $16,543/year  Collection of School Sites (paid by MNSD)= $31,930.08/year  Allowed a minimum increase of 1%/year with a maximum increase of 3%/year with the actual increase being tied to inflation We must discuss vendor selection and decide if we should go with automated or manual refuse collection and if we should join the Waukesha County Recycling Program. 1. I recommend entering into a contract with Advanced Disposal based on past track record, the submitted proposal and that they are the lowest cost. 2. I recommend joining the Waukesha County recycling cooperative. The increased cost to have the recyclables delivered to the joint materials recycling facility (MRF) is $11,244.00 per year, however, our estimated Page 1 of 2 dividend from joining the MRF is $31,393.00 more than our current DNR grant so we would see an estimated cost saving by joining the County program is $20,149 per year. 3. Converting to automated collection is an increase in collection expenses of $0.22/household/month which equates to $2.64/household/year. This is a yearly increase of $24,736.80 should we decide to convert to automated cart collection. I feel that this should be a Committee decision based on what you feel your constituents would like the most. I personally have had cart service and liked it very much. I also receive an inquiry every few months from a resident asking if we would consider carts. Recommendation for Action by Committee: Recommend completing a contract with Advanced Disposal to bring back to the Common Council for approval once the City Attorney has reviewed it. I also recommend joining the Waukesha County Recycling Program and the Committee making a recommendation regarding automated collection. Proposed Program Implementation Plan and Services 11. Transition Plan: Provide a detailed implementation schedule / timeline that demonstrates your ability to effectively locate and use necessary resources for successful program implementation, including the following: Key implementation dates (the service commencement dates) Identification of any truck purchase commitment and delivery schedule Identification of any receptacle purchase commitment and delivery schedule City outreach and City relations plan - education Customer service plans Special services/billing services plans Materials processing and disposal plans, reporting plans LUG coordination plans, Transition staffing and training plans Any collection of old containers and distribution of new ones VENDOR RESPONSE: Upon finalization and award of contract to Advanced Disposal, Advanced Disposal will work with the City and responsible staff regarding maintaining current or implementation of new services (automated trash collection). Depending on the timing of this decision, and the desire of the respective elective bodies, Advanced Disposal plans the following: • Negotiate final contract and services • Meetings with municipal staff or elected bodies to determine an implementation timetable, factors include: December Holidays and New Years, decision of utilizing County Joint MRF or Contractor-chosen facility, etc., Refuse and Recycling Collection and Disposal Services Program For the City of Muskego • A proposed timetable would be as follows, but would be subject to changes based on above, assuming conversion to automated collection of solid waste: o Award contract to Advanced Disposal by 9/30  Reviewing rates, billing based upon chosen services, etc.  Review contact directory, at municipality and Advanced Disposal, for issue reporting or needs o Finalize equipment purchases and capital needs the first week of October o October, meet with City Staff and review “Cart Guideline” brochures to be delivered with the new solid waste carts o Begin delivery of carts the week of February 22, 2016; estimated two-week delivery period, fully automated solid waste collection would begin Monday, March 7 o As the incumbent, Advanced Disposal allows the municipality flexibility in determining a implementation schedule that best benefits their community and its residents 12. Commencement of Services: Do you have the ability to fully implement programs and services NO LATER THAN JANUARY 1, 2016. Are you able to accommodate earlier commencement dates based on this proposal? VENDOR RESPONSE: As the current service provider, Advanced Disposal is best positioned to make any possible transition the easiest. If there is not a change to the collection type, services would simply continue as current. If the City chooses to convert to carts, Advanced Disposal would recommend a transition in late February or March. Our experience shows that with Wisconsin weather, combined with the holidays in December and the New Year, it is less of a burden for Residents. If desired by the City, conversion to carts for a start date of January 1, 2016 is possible, but not recommended. 13. Commencement of Services Collection at City Buildings and Designated Sites: Does your firm agree to pick up at designated sites without additional charge to City and conduct a receptacle audit within the first year of contracted services? VENDOR RESPONSE: Yes 14. Container Provisions: Explain how your firm will comply with the required acquisition, delivery, maintenance, repair and additional receptacle specifications listed if the City chooses Automated Collection. Please describe plan for provision of refuse and recycling receptacles. VENDOR RESPONSE: Our experience in having carts delivered to residents in the City of Waukesha, Town of Waukesha, Village of Hartland and numerous others, is unparalleled. In fact, from 1/1/2015-3/31/2015, Advanced Disposal and its team Refuse and Recycling Collection and Disposal Services Program For the City of Muskego delivered over 80,000 carts in Waukesha County as part of various contracts awarded. Advanced Disposal would provide all household units with brochures that are “Cart Guidelines” to explain the new process for solid waste collection, acceptable recyclable items, and collection days. Advanced Disposal will also have information for each community listed on its website, with the ability to sign up for “Service Alerts”. On the “Cart Guidelines”, information would be provided explaining the steps for Residents to request a new cart due to damage, theft or other information. Advanced Disposal would maintain and repair all carts within the City based on the specifications provided by the City. 15. Special Allowances for Collection in Alleys and Tight Spaces: describe how pick up for geographically challenging areas that will not accommodate full-sized automated vehicles will be handled. VENDOR RESPONSE: As the current service provider, Advanced Disposal is currently utilizing standard pick-up truck for these locations. As the current service provider in “Up-the-Drive” communities such as the City and Town of Brookfield, we have numerous pick-up trucks with dump hoppers and tarping systems to ensure there is not any commingling of solid waste and recycling. 16. Refuse and Recycling Collection and Disposal Services Program For the City of Muskego Car Seat Recycling Advanced Disposal works with Safe Kids Wisconsin to hold car seat recycling events throughout the state giving parents the opportunity to discard outdated and unsafe car seats. All car seats have an expiration date that can be found on the manufacturer’s label. If there is not an exact expiration date listed, a general rule is to dispose of the car seat six years from the manufacture date. Seats used after their expiration date may not be safe or hold up in a crash. Seats more than six years old, purchased at a garage sale or thrift store, or involved in a crash are collected and dismantled to be disposed of properly. During the 2014 event, nearly 2,000 dangerous car seats were collected. Electronics Recycling Advanced Disposal holds electronic or e-recycling events to give residents and businesses the opportunity to discard unwanted electronics, such as computers, printers, faxes, televisions, phones, etc. In this day and age, electronics are obsolete and thus are often replaced at a rapid rate. These items have to be discarded in a cautious manner in order to protect natural resources. Illinois bans the disposal of any electronics in landfills as does Wisconsin and Minnesota. At the e-cycling events, Advanced Disposal partners with a preferred vendor that is responsible for recycling the materials. We will only partner with those vendors that provide written proof that the collected electronics are not sent overseas to be broken apart. With this proof, we can rest assured that the electronics are being recycled in a manner that is safe to the environment. Advanced Disposal Decatur and Charleston (Ill.) along with Valley View Landfill collected more than 26,000 pounds of electronics when they partnered with Macon County’s Environmental Management Department, Progress City USA/Richland Community College and Advanced Technology Recycling (ATR). Holiday Wreaths for Veterans Employees at our Green Bay, Wis., were inspired by an area veteran who took it upon himself to place holiday wreaths on the veterans’ graves a local memorial park. When he needed corporate sponsorship to turn the practice into an annual tradition, Advanced Disposal jumped at the chance to offer financial support to honor deceased veterans who had proudly served their country. We make sure we have a presence and provide information at community events such the Blaine Green Expo in St. Paul, Minn., and the Northbrook, Ill., Farmer’s Market Art of Recycling Day. Presentations are targeted to our audiences’ knowledge and interest with the same goal – to raise awareness. Supporting Charitable Organizations Throughout the year and the Midwest Region, our employees get dirty, get cold, get walking and get collecting for various charitable organizations. In Muskego, a team of employees took part in the Wisconsin area “Tough Mudder”, a competition that held across the country and throughout the world that challenges participants to conquer hardcore obstacle courses designed to test their all around strength, stamina, mental grit and camaraderie. The Wisconsin team, of four, raised $720 for the Froedert Hospital Foundation Child Life Program. Our Decatur, Ill., office is one of the most active taking part in fundraisers throughout the year including the “Polar Plunge”. Team “Trash Talkers” endured the 35-degree waters of Decatur Lake this year to benefit the Special Olympics. Advanced Disposal - Rockford and Orchard Hills Landfill have partnered with Marengo (Ill.) High School softball players to “Run Out Hunger” in the community. Advanced Disposal agreed that for every run the team scored at home during the Refuse and Recycling Collection and Disposal Services Program For the City of Muskego 2013 season, the company would donate $10 to the M.O.R.E. Center (Marengo area OutReach Enterprises), an organization which aides needy individuals and families in the Marengo area. The team’s tremendous effort resulted in $720 being raised. So it was a natural fit for Advanced Disposal to sponsor a competition between the two universities to see which campus places higher in Recyclemania, an annual nationwide college campus recycling competition. In 2014, UW-Stout took the prize ̶ a $2,500 donation to the winning school’s general scholarship fund, by cutting its landfill waste by 43 tons compared to the previous year; the school also produced more compost than trash, and led all 14 Wisconsin colleges competing in Recyclemania. Bidder’s Representation Refuse and Recycling Collection and Disposal Services Program For the City of Muskego CITY OF MUSKEGO Staff Report to Public Works Committee To: Public Works Committee From: David Simpson, P.E., Director of Public Works/City Engineer Subject: Review and Approval of Intergovernmental Cooperative Agreement for Recycling Program Consolidation with Waukesha County Date: September 17, 2015 As part of the previously discussed proposals for refuse/recycling collection we have discussed the possibility of joining the Waukesha County recycling program. The Committee has previously stated that we would consider joining if there was a cost benefit, which we now know there is. Below are the calculations that show we would be saving costs if join the program.  Cost for Recycling Collection for Contractor Retained= $1.98/HH/Month x 9370HH= $18,552.60/month + cart cost of $0.38/HH = $22,113.20/month  Cost for Recycling Collection with delivery to Waukesha County facility= $2.08/HH/Month x 9370HH= $19,489.60/month + cart cost of $0.38/HH = $23,050.20/month The increased cost to have the recyclables delivered to the joint materials recycling facility (MRF) is $11,244.00 per year, however, our estimated dividend from joining the MRF is $31,393.00 more than our current DNR grant so we would see an estimated cost saving by joining the County program is $20,149 per year. If we don’t like the cooperative or are not receiving what we thought we are allowed out of the contract at any time with a one year notice. The attached agreement is under review by our attorney as I write this memo and should have results by the meeting date. Having this agreement finalized now makes everything transition much smoother as we are required to apply for WDNR grants by the end of September. Page 1 of 1 9/16/2015 Page 1 of 4 Intergovernmental Cooperative Agreement Recycling Program Consolidation with Waukesha County WHEREAS, pursuant to Section 287.09(1)(b) of the Wisconsin Statutes, Waukesha County (the “County”) has adopted a resolution making it the Responsible Unit (“RU”) for the entire County except for those municipalities in the County that passed a resolution to retain their own individual RU status; WHEREAS, pursuant to Section 287.09(1)(c) of the Wisconsin Statutes, the City of Muskego (the “City”) passed such a resolution thereby retaining its individual RU status; WHEREAS, under Chapter 287 Wisconsin Statutes, as RUs, both the City and the County are each responsible for compliance with the requirements for an “Effective Recycling Program”; WHEREAS, through State recycling grants, the Wisconsin Department of Natural Resources encourages recycling program efficiencies such as intergovernmental agreements and program consolidations; WHEREAS, the County recently entered into a new partnership with the City of Milwaukee for a jointly owned Material Recovery Facility located at 1301 W. Mt. Vernon Ave. in the Menomonee Valley (“Valley MRF”). New municipal recycling partners, in addition to the twenty-five (25) existing municipal partners in the County recycling program, will help further reduce recycling program costs and local taxes; WHEREAS, in 2015, the City adopted resolution 055-2015 requesting information from the County regarding the potential financial impacts of joining the County recycling program; WHEREAS, in 2015, the City completed a competitive request for proposals process for solid waste and recycling collection and processing services, the results of which demonstrate the positive financial impacts of joining the County recycling program; and WHEREAS, it is in the mutual best interests of the County and the City to work together for the purpose of implementing efficiencies related to operating an effective recycling program in accordance with Sections 287.11 and 287.24, Wis. Stats., and Chapter NR 542, Wis. Adm. Code. NOW THEREFORE, in consideration of these premises, and by the authority granted under Sections 287.09(1)(d) and 66.0301 of the Wisconsin Statutes, the City and the County, hereby agree as follows: 9/16/2015 Page 2 of 4 (1) “Responsible Unit” Designation. To implement efficiencies in operating an effective recycling program and to qualify for recycling consolidation grants under Section 287.24, Wis. Stats., the City, for the term of this Agreement, hereby designates the County to serve as its RU under Chapter 287, Wisconsin Statutes, in lieu of itself. (2) Recycling Program Responsibilities. (a) County responsibilities. The County, as RU, shall provide the following services on behalf of the City: I. Those services required for an “Effective Recycling Program” under Chapter NR 544 Wisconsin Administrative Code, or as a condition of a State recycling grant under Chapter NR 542 Wisconsin Administrative Code: (i) Provide for the processing and marketing of all recyclables delivered by the City to the County designated MRF; (ii) Implement a public information and education program to inform residents of the reasons to recycle, local opportunities and procedures to recycle, and the recycling prohibitions under State law; (iii) Adopt and enforce County Code provisions regulating the separation of recyclables at residences and businesses, and the delivery of residential recyclables from all partner municipalities to the County designated MRF; (iv) Complete annual grant applications and manage State recycling grants that may be available; (v) Maintain program recycling and solid waste records and complete reports as required by the State; (vi) Cooperate with the City on the implementation of all duties assigned in this Agreement; and (vii) Allocate County staff and other resources necessary to provide the services noted in this section. II. Other recycling services not required by State code: (i) Assist the City with recycling and solid waste contract procurement processes and related analysis for residential collection services; (ii) Provide an annual recycling dividend payment to the City, if any, based on the tons of City recyclables delivered to the County designated MRF, and City recycling program costs for that year. It is understood that total annual dividend payments, if any, to partner municipalities, including the City, depend on recycling markets, processing contracts, state grants, and the County recycling program fund balance. The County will notify the City at least one (1) year prior to any proposed reduction to the annual County budget for dividend payments. (b) City Responsibilities. The City shall provide the following services at no cost to the County: 9/16/2015 Page 3 of 4 I. Cooperate with the County, take all actions and execute any documents that may be necessary for the County as RU to apply for, obtain and use financial assistance and consolidation grants available under Chapter 287, Wisconsin Statutes, on behalf of and/or for the benefit of the City; II. Provide residential recycling collection services within the City in accordance with Section 287.11(e), Wisconsin Statutes; III. Deliver all collected residential recyclables to the County designated MRF in accordance with adopted delivery protocol; IV. Through the City’s recycling collection contract: (i) Incorporate adopted protocol for the delivery of recyclables to the County designated MRF; (ii) Require the hauler to keep records and provide the necessary data and reports to the County as needed to administer this Agreement and maintain compliance with applicable state or local codes, program rules, and the County designated MRF delivery protocol. This includes, but is not limited to, providing up-to-date information on haul routes, collection days and times, and vehicles used to collect recyclables. V. Provide the County a copy of the current City recycling and solid waste collection contract and any future amendments. VI. Keep records and, through an Internet-based County reporting system, enter annual data required to complete State recycling grant applications and annual reports within County deadlines; VII. Cooperate with the County on the implementation of all duties assigned to the County in this Agreement. (3) Miscellaneous. (a) Authority and Responsibilities. Nothing in this Agreement forfeits any Responsible Unit rights and responsibilities of the County, or any other City or County authorities under state or local laws. Upon termination of this Agreement, the City’s designation of the County as RU shall automatically cease and the City shall reassume all of its rights and responsibilities as RU within the City. The County shall have no further obligation to the City with respect to the City’s Effective Recycling Program. (b) Effective Date, Term. Upon execution by both parties, this Agreement shall become effective on January 1, 2016, and shall remain in effect through December 31, 2024 (Valley MRF operating contract term), unless otherwise terminated in writing by either party upon a one (1) year notice to the other party. After the initial term, this Agreement shall be renewed automatically for additional five (5) year terms, unless otherwise amended or terminated. Any Party that wishes not to renew this Agreement at the end of the then current term shall provide written notice of such intent to the other Party not later than 365 days prior to the end of the then current term. Unless otherwise agreed between the Parties, a failure to timely provide such notice of non- renewal shall render said notice invalid and the Agreement shall automatically renew pursuant to the terms of this Agreement. 9/16/2015 Page 4 of 4 (c) Termination for Cause. Failure of any party to perform its material obligations under this Agreement shall constitute a breach entitling the non -breaching party to terminate this Agreement if within thirty (30) days of receipt of written notice of the breach, the breaching party has not cured the breach. If the breaching party is diligently pursuing a cure but such cure cannot reasonably be accomplished within thirty (30) days, the breaching party may seek permission from the non-breaching party for up to an additional thirty (30) days to cure the breach, and such permission shall not be unreasonably withheld, conditioned or delayed. (d) Force Majeure. If the performance of any part of this Agreement by the County or the City is delayed or rendered impossible by reason of natural disaster, flood, fire, riot, explosion, war or actions or decrees of governmental bodies (a “Force Majeure Event”), the nonperforming party shall immediately give notice to the other party of the natu re of such conditions and the extent of delay and shall do everything possible to resume performance. Such nonperformance shall not constitute a breach of this Agreement so long as the nonperforming party is diligently seeking to resume performance. If t he period of nonperformance exceeds thirty (30) days from the receipt of notice of the Force Majeure Event or the nonperforming party does not diligently seek to resume performance, the party receiving notice may, by giving written notice to the nonperforming party, terminate this Agreement. By resolution or ordinance adopted by its governing body, each Party has authorized and directed the representatives of the governing body to enter this Agreement on behalf of the Party. Date: September 17, 2015 New Information: The MMSD completed the work outlined in the intergovernmental agreement discussed below but would like to extend the completion date so that they can complete one more test. The work will be completed in a way to minimize any disruption to our system and we will again receive any data collected. Previous Information: The City’s main pump station (McShane Pump Station) discharges into a force main that travels straight west out of the City and then northeast in Franklin to a MMSD gravity interceptor sewer (see last page of attached agreement). The force main was constructed in 1984 and has never been inspected, mostly because the technology to inspect a force main while active is relatively new. The portion of the force main in the City of Muskego is owned by the City and the portion in Milwaukee County is owned by the MMSD. The MMSD would like to inspect their section of force main and have offered to inspect our portion as well. To inspect the force main an entry port must be install on the upstream end of the force main to allow for insertion of an inspection orb. The MMSD is willing to pay for the installation of the port and the cost of the inspection. Once installed we will own the port and be able to utilize it for any future inspection needs we may have. The attached Intergovernmental Agreement has been reviewed by the City Attorney and is approved as to form. The District and the City amend Section 4 Effective Dates to extend the termination date from July 1, 2014, to February 1, 2016. 4. Effective Dates This Agreement becomes effective on January 1, 2014, and terminates on February 1, 2016. Section 6(D) survives this termination.
