Page 1 of 1 CITY OF MUSKEGO Staff Report to Public Works Committee To: Public Works Committee From: David Simpson, P.E., Director of Public Works/City Engineer Subject: Discuss request for boulevard modification at W128 S9091 Boxhorn Reserve Drive Date: August 7, 2015 The attached request was received from the owners of W128S9091 Boxhorn Reserve Drive. The owners are asking that the City consider shortening the length of the boulevard in front of their home. This picture shows the driveway and boulevard in question. The boulevard was designed and constructed when the Subdivision was first constructed in 2005 and the owners just completed construction of their home recently. I feel that the existing access is adequate and that there is no need to disrupt and potentially damage the City street. Should the roadway be reconstructed in the future we could consider changes at that time if the owner wishes. The placement of the home, including the decision to construct a front entry garage was the sole decision of the owners. Had the home be moved further north or a side entry garage be considered the driveway would have been totally north of the boulevard. You can see the placement on the attached Plat. Recommendation for Action by Committee: Deny request for modifications to the existing boulevard on Boxhorn Reserve Drive at Boxhorn Drive. 1 David Simpson From:Booth Sent:Wednesday, July 01, 2015 11:49 AM To:David Simpson Subject:Median Issue in Boxhorn Reserve Drive Attachments:photo 1.jpg; photo 2.jpg Hi Dave – I spoke with Kelly at City Hall yesterday and she gave me your information so I could reach out. My husband and I recently moved into the Boxhorn Reserve subdivision. We reside at W128S9091 Boxhorn Reserve Drive (first blue house on the left). Since we’ve moved in we have had an issue with the median in respect to how we enter and exit our driveway. Because the median extends pretty far into the subdivision it means we have to make a backwards turn into our driveway and also hinders how we back out of our driveway. It becomes even more of a problem when we have multiple cars in the driveway. We were hoping that something can be done to shorten the median to make access to our driveway more reasonable. When we built our house we positioned it as far north as possible in order to avoid the median but we couldn’t go any further and still have a problem. We would propose that the median be shortened by at least 13’8” which is a measurement from the inside start of the median concrete to the second cut line in the concrete (right where the tree sits). I’ve attached some pictures so you could see exactly what I’m talking about. The first is a view from standing in our driveway and the second standing from the house across the street’s yard. By shortening the median by at least this amount we will have full access to our driveway without having to turn backwards to get into it and avoiding the median while trying to back out of it. The right-of-way in question is not improved in any way and currently is grass/lawn area. DISCUSSION PC 047-2015 Relating to the right-of-way vacation, all of the proper documents have been submitted to proceed with the right-of-way request. The request is also proceeding through the Public Works Comm ittee for their review. There are no expected concerns with this right -of-way vacation request. With the vacation, each tax key parcel abutting the vacated right of way gets half of the adjacent right -of-way back as part of their lot. The Planning and Engineering Divisions do not see any major problems with the requested vacation. As such, staff is recommending approval of the right-of-way vacation. CITY OF MUSKEGO Staff Report to Public Works Committee To: Public Works Committee From: David Simpson, P.E., Director of Public Works/City Engineer Subject: Review condition assessment results of City owned pathways Date: August 7, 2015 The Engineering Division has completed an inspection of all City owned pathways in the City. This was completed by our Engineering Intern by walking every pathway in the City and utilizing GIS to link pictures to actual GPS located points. I have attached maps and examples of condition findings to help demonstrate the results of the inspections. We rated conditions of pathways utilizing a grading system of A-F and you can see on the attached examples what each rating might look like. You can also see the current condition total of each type of trail surface on the attached maps. In summary, overall condition ratings are as follows: Paved Pathways: 19.5 miles at A or B, 1.2 miles at C, and 4.5 miles at D Stone Pathways: 7.75 miles at A or B, .8 miles at C, and 2.5 miles at D No overall section was rated with an F, however, there are certain spots rated with an F. City crews will be making repair to any spots marked by an F rating as time allows. I recommend that inspections take place next year again to determine if any sections are deteriorating quickly and we begin to make plans for repairs to larger sections then. Recommendation for Action by Committee: Continue to monitor pathway conditions and plan for spot repairs now. Page 1 of 1 Trail Inspection Rating Scale: A – Informational rating or a warning of potential damage to trail in the future. Trail or area of trail is like new and in no need of repair. Example of such damage would be a hairline crack or a small 4in long crack forming across the trail. B – Area of trail where damage exists yet is too premature for repair. Trail or area of trail is safe for travel. Damage wouldn’t pose a threat to safety until the distant future if it were to progress. An example of such damage would be a crack that is the full width of the trail at 0.25in or less wide. C – Area of trail that is functional yet has damage that may be worth fixing in the near future. An example of such damage would be a crack that is the full width of the trail and 0.25-0.5in wide. D – Area of trail that is top priority once maintenance is set to begin. Trail or area of trail may be functional yet is damaged to the point where if left untreated could very easily become a future safety hazard. An example of such damage would be a crack that is the full width of trail and 0.5-1in wide. F – Area of trail that is currently or could be in the very near future a pedestrian safety concern. Damage should be fixed sooner rather than later as continued damage to area could increase safety risk or even cause injury. A large crack that could cause someone to trip and fall would be an example of such damage. Trail Damage Examples By Grade A Grade: Small cracks beginning to form across the trail both less than 0.25in in width. B Grade: Two cracks at or near 0.25in wide that extend across the trail. C Grade: Multiple 0.25 to 0.5in wide cracks running parallel to the trail. 0.5in wide crack across the trail. D Grade: 0.75in wide crack across trail between two depressions that have multiple cracks. Multiple 0.5 to 0.75in cracks across the full width of trail with small heaves formed. F Grade: Large pieces of pavement missing from path. 3in wide crack across the full width of trail. Committee To: Public Works Committee From: David Simpson, P.E., Director of Public Works/City Engineer Subject: Discuss offer from Cricket Communications, Inc to transfer ownership of their wireless equipment on the Mercury Drive water tower to the City Date: August 7, 2015 The attached offer was received from Cricket Communications. They are going to be terminating their lease with the City for their use of the water tower site for their cellular site needs. As part of our lease agreement they are required to move all equipment off of the water tower site. They are proposing to leave their equipment in place in exchange for paying the City $15,000. We would then negotiate with future carriers to remove or reuse the equipment. If that did not work out we would remove the equipment with a future project such as painting. Because we could wrap it into a large scale future project if need be the cost to the City is anticipated to be around $5,000. The City Attorney would have to review this agreement prior to approval by the Common Council if we recommend approval at the Committee level. Page 1 of 1 Market: MKE Site Name: Muskego WT Site #: MKE-111-B Fixed Asset #: TERMINATION AND EQUIPMENT TRANSFER AGREEMENT This Termination and Equipment Transfer Agreement (the “Agreement”) is made effective this ____day of ____________, 2015 (the “Effective Date”), by and between Cricket Communications, Inc., a Delaware corporation, with an address at 7337 Trade Street, Suite 1600, San Diego, CA 92121, Attn: Network Real Estate Administration (“Cricket”), and City of Muskego, with an address at c/o Mayor’s Office City Hall, W182 S8200 Racine Avenue, Muskego, WI 53150 (“City”). WITNESSETH WHEREAS, Cricket and City (or its respective predecessors) are parties to a certain License Agreement (the “License”) dated March 31, 2008, whereby Cricket was entitled to install, maintain, operate and remove communications equipment and appurtenances described in the License (the “Equipment”) at a tower/structure owned or operated by City and located at W188 S8273 Mercury Drive, Muskego, WI 53150 (the “Site”); and WHEREAS, Cricket has notified City that Cricket intends to terminate the License; and WHEREAS, the parties wish to modify Cricket’s responsibility for removal the Equipment from the Site under the License; and NOW, THEREFORE, the parties hereto, in consideration of the mutual covenants contained herein and intending to legally be bound hereby, agree as follows: 1. Termination of License: City hereby acknowledges and agrees that as of the Effective Date, this Agreement shall serve as notice of Cricket’s termination of the License. The License shall terminate as of October 31, 2015 (the “License Termination Date”), rendering the License null and void. All rights and obligations of the parties under the License shall terminate as of the License Termination Date, except for those rights and obligations which expressly survive the termination of the License. 2. Consideration: As consideration for City’s agreement to the terms and conditions described herein, including but not limited to City’s assumption of the obligation to remove any and all Equipment remaining at the Site, Cricket agrees to pay the amount of Fifteen Thousand Dollars and No/XX ($15,000.00) (the “Pay and Walk Fee”) within sixty (60) days after the full execution and delivery of this Agreement. The Pay and Walk Fee is accepted by City and is agreed by both City and Cricket to be the full consideration for all remaining rental payment, termination fees or other monies owed to City under the License. 3. Transferred Equipment: All of Cricket’s right, title, and interest in and to the Equipment that remains located at the Site, as referenced and attached hereto as Exhibit A, (the “Transferred Equipment”) shall be deemed to be automatically transferred to City free and clear of all liens and encumbrances, as of October 31, 2015 (the “Transfer Date”). The Transferred Equipment includes the cabinet and adjoining structural components, and all other equipment remaining on the Site as of the Transfer Date. City shall be solely responsible for, and shall pay, any and all taxes, including sales/use/property taxes that may be due in connection with the transfer of the Transferred Equipment. City agrees to assume all of the rights and obligations of Cricket, including removal, for the Transferred Equipment. 1 4. Hazardous Substances: City hereby acknowledges that the Transferred Equipment may include electronic equipment, batteries and emergency power engines which contain substances that may be identified as hazardous, toxic and/or dangerous under applicable federal, state and/or local laws and regulations (“Hazardous Substances”). From and after the Transfer Date, City agrees to hold harmless and indemnify Cricket, and to assume all duties, responsibilities and liabilities at the sole cost and expense of City for payment of penalties, sanctions, forfeitures, losses, costs or damages, and for responding to any action, notice, claim, order, summons, citation, directive, litigation, investigation or proceeding, to the extent arising from the Transferred Equipment, including any electronic equipment, batteries, and emergency power engines, and any Hazardous Substances derived therefrom, that arise subsequent to the Transfer Date. It is the present intention of City that the Transferred Equipment, including without limitation any electronic equipment, batteries, and emergency power engines if present, will be used again for their original intended use, rather than scrapped or disposed of. 5. No Warranty: The parties hereby explicitly acknowledge and agree that the Transferred Equipment is being transferred “as is, where is” with all faults and without warranty. NOTWITHSTANDING ANYTHING HEREIN TO THE CONTRARY, ALL WARRANTIES AND REPRESENTATIONS OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, AS TO THE CONDITION, QUALITY, MERCHANTABILITY AND FITNESS OR SUITABILITY FOR ANY PARTICULAR USE OR PURPOSE ARE HEREBY EXCLUDED AND DISCLAIMED. CRICKET SHALL HAVE ABSOLUTELY NO OBLIGATION TO REPAIR OR REPLACE ANY OF THE TRANSFERRED EQUIPMENT. 6. Indemnification: Cricket shall indemnify and hold harmless City against claims of third parties in or to the Transferred Equipment that arose prior to the Transfer Date. City shall indemnify and hold harmless Cricket against claims of third parties relating to the Transferred Equipment that arise subsequent to the Transfer Date. 7. Waiver and Release: In consideration of this Agreement, Cricket hereby waives remuneration for the full market value of the Transferred Equipment. As of the Transfer Date, City hereby releases Cricket from all of the remaining responsibilities and obligations of Lessee/Tenant/Licensee under the License, including removal of the Transferred Equipment. The parties specifically acknowledge that the License contained provisions that were expressly intended to survive the expiration or termination of the License. The foregoing notwithstanding, the parties agree that any such responsibility or obligation shall remain in full force and effect and is incorporated by reference into this Agreement. City agrees to release and hold Cricket harmless for any defect in the Transferred Equipment. 8. Construction: Each party has had the opportunity for its own counsel to review this Agreement and participate in its drafting. Therefore, the rule construing the document against the drafter shall not apply to this Agreement or against any party. 9. Amendment: No amendment, supplement, modification, or waiver or termination of this Agreement and, unless otherwise specified, no consent or approval by any party, shall be binding unless executed in writing by the party to be bound thereby. 10. Waiver: No waiver by either party of any provision herein shall be deemed a waiver of any other provision or of any prior or subsequent breach of any provision herein. 11. Assignment: Neither this Agreement nor any rights or obligations under this Agreement shall be assignable by either party without the prior written consent of the other parties. 2 12. Authorization: The signatories hereto represent that they are duly authorized to execute this Agreement on behalf of their respective entities. 13. Binding Effect: This Agreement shall be binding upon and inure to the benefit of the parties’ respective successors and assigns. 14. Choice of Law: This Agreement shall be construed in accordance with, and all disputes hereunder shall be governed by, the laws of the State where the Site is located. 15. Counterparts: This Agreement may be executed in more than one original, and the parties agree that each original executed shall be treated as the original for all purposes. Facsimile signatures shall be acceptable to both parties and shall be deemed original signatures. 16. Severability: If any term, covenant or condition of this Agreement, or the application thereof to any person or circumstance, shall to any extent be invalid or unenforceable, the remainder of this Agreement, or the application of such term, covenant or condition to other persons or circumstances, shall not be affected thereby, and each term, covenant or condition of this Agreement shall be valid and enforceable to the fullest extent permitted by law. 17. Survival: All terms, covenants and obligations contained in the Agreement shall remain in full force and effect without any limitation.
