Signage has been indicated as two 2.5’ x 10’ and one 4’ x 20’ temporary banners that will be hung from each side of the tent and small directional signs at the entrances of the parking lot. Operations are proposed from June 15th – July 12th, 2015, from 8:00 am to 9:00 pm. Permission has been received from the property owner to use the site and the restroom facilities. DISCUSSION PC 002-2015 The proposal is consistent with operations of other vendors in Muskego and for this site. A transient merchant license must be obtained from the City Clerk’s Office. The Fire Department brought to the attention of the Planning Department their Wisconsin Chief Fire Officer Guidebook. Within the guidebook it states that storage and handling of fireworks may not occur within 50 feet of a dwelling, public assembly, or where gasoline or volatile liquids are dispensed in quantities greater than 1 gallon. The proposed site meets the guidebook requirements. Once again this year, as in the past, a storage contain er is proposed on site. There have been no problems with the storage container in the past. The container will be located within a parking stall along the Moorland Road side of the lot. DISCUSSION PC 006-2015 Upon review of the CSM, the bulk requirements of the code appear to be met. There are some minor technical corrections that need to occur that will need to be addressed before the CSM can be signed by the City and recorded. The one main comment relates to making sure that there is a suitable building pad on Lot 2 due to the location of the 100-year floodplain. It has been stated that a home is currently being designed to fit within the limited building pad on Lot 2. Before the CSM can be recorded the City must receive a preliminary survey and building plans, along with a preliminary grading plan, showing how a home can feasibly be built on Lot 2. Staff recommends approval subject to meeting all technical corrections received from the Engineering Division and providing the proper survey and grading plan to planning and engineering staff, as noted above. The Resolution is drafted accordingly. The proposed land division is unique, as outlined below, thus requiring this initial conceptual discussion before the Planning Commission. The petitioner is requesting conceptual approval to get comments from the Planning Commission regarding the proposal. The petitioner will be present at the meeting to further explain the conceptual land division and to answer any questions. No formal approval or denial will be given at this meeting and no guarantees can be made. This conceptual discussion is intended to solicit comments, suggestions, and ideas. If the petitioner wo uld like to take the next step and eventually apply for a formal CSM, the comments received at this meeting must be addressed as part of the formal submittal. PLAN CONSISTENCY PC 003-2015 Comprehensive Plan: The 2020 Plan depicts the area for Low Density Residential (.5-.99 units/acre). The proposed concept is consistent with the Plan. Zoning: The property is zoned RS-2 – Suburban Residence District. This zoning requires minimum lot sizes of 40,000 SF and average lot width of 220’ where municipal sewer is not present. The two proposed conceptual parcels appear to meet these requirements based upon the dimensions and areas calculations provided. DISCUSSION PC 003-2015 Per the submittal the petitioner would like to break off an approximate 2.32 acre parcel from their existing 7.1 acres of land along Mystic Drive. Usually a small land division like this would proceed straight to full CSM approval. However, Plan Commission will note that the existing lot is served by an existing 80-foot wide ingress/egress easement (recorded documents attached in the supplement). This easement has been in place servicing this lot as it’s only access for many decades. The petitioner would like to divide the existing lot and utilize the existing access easement for the newly desired created lot as well. As Plan Commission knows, Muskego land division code states that any new parcel of land must have frontage on a public right of way. This rule can be waived though by Plan Commission if desired. There aren’t specific rules to follow for Plan Commission to waive this land division rule as we haven’t come across such a case in the past from what staff has researched. Usually staff would strictly tell a petitioner that such a land division will not be approved upfront, but gi ven the uniqueness of the situation staff felt that this conceptual discussion was warranted. DIRECTION PC 003-2015 The way that the petitioner has the proposed land division laid out will easily allow each parcel to have plenty of frontage on the access easement. Further, the lots proposed more than meet the existing zoning and the comprehensive plan density for the area. Lastly, staff doesn’t see the proposed land division hampering the surrounding area in any way. In all, staff doesn’t see issue with approval of such a land division due to the above circumstances. In any other case staff wouldn’t recommend approval, but given the adequate easement we look upon the proposed fondly. A future formal CSM would of course have to formally verify the easements and we would want some sort of documentation from the neighbors who utilize the easements that they have no concern. DISCUSSION PC 004-2015 As Plan Commission knows, the former Shell Gas Station lot, on the NW corner of Lannon Drive and Janesville Road, has been vacant for a couple years now. The vacancy was a result of the Janesville Road reconstruction project. Waukesha County required that the structures be removed on the property to make way for the reconstruction, however, the private owner has retained the vacant leftover remnant. Since this time the property has sat vacant with the majority covered in hard surface asp halt. The portions covered in asphalt are required due to a Wisconsin Department of Natural Resources cap order since the parcel is largely contaminated underneath. Basically, building can still occur on the lot but if any soils are disturbed on the property they would have to be tested and remediated. Mr. John Jewell is the owner and builder of the new property across the street where the former BP Gas Station existed. Mr. Jewell is having parking issues at his new site and sees an opportunity to remediate/beautify the former Shell site while providing more parking options for his tenants and patrons. Mr. Jewell’s intent is to come forward to the city with a new site plan for parking on this corner that meets city codes and also works in beautification efforts with landscaping improvements. In the meantime Mr. Jewell seeks Plan Commission approval to use the existing asphalt for temporary parking as shown on the attached site plan. The plan shows access to the parking lot off the existing access point on Janesville Road. A total of twelve (12) temporary parking stalls would then be found with proper access. The east end of the proposed temporary lot may include more stalls or be an opening for possible shared access to Tres Locos to the north. Mr. Jewell seeks the temporary parking approval until the end of 2015. During the course of the next few months Mr. Jewell intends on developing a new site plan for a permanent parking lot. Further Mr. Jewell will be seeking city approval for incentives in this remediation and beautification effort. Such a partnership is desired since the lot is contaminated and has limited re-usability. Further, the lot is restricted as Waukesha County will not allow any use of the lot in the right-of-way portions (thus city aid may also be required to beatify this asphalt right-of-way area as well). This is the building shared with Central Bark. Various façade applications have been erected that require Plan Commission approval as outlined below. DISCUSSION PC 005-2015 Please find enclosed a request from Body By Design, a new business to Muskego, to be allowed to keep various black silhouette pictures along the north and east facades of the structure. Body By Design moved to Muskego in late 2014 and have made many great improvements to the outside and inside of the property and structure. During this time the business erected seven (7) black plastic silhouettes. Each silhouette resembles people exercising as exercise is Body By Design’s business. Plan Commission approval is required since the applications are altering the approved façade for the structure. The applications don’t fit under the City’s sign ordinances and are strictly up to the Plan Commission on how they relate to the aesthetics of the property/structure and how they may affect the surrounding business neighborhood. STAFF RECOMMENDATION PC 005-2015 Approval of the silhouettes since they apply to the aesthetics of the building well and are removable. The resolution is subject to the removal of the silhouettes should the business leave. THEREFORE BE IT RESOLVED, That the Plan Commission approves a building, site, and operation plan amendment for Body By Design located at the building in the NE ¼ of Section 16 (S81 W18460 Gemini Dr / Tax Key No. 2222.984.003). BE IT FURTHER RESOLVED, That the silhouette applications are removed in the event that the business leaves the property. BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall result in the imposition of fines, the initiation of legal action, or both.
