Unapproved CITY OF MUSKEGO COMMITTEE OF THE WHOLE MINUTES November 25, 2014 6:35 PM City Hall, W182 S8200 Racine Avenue CALL TO ORDER The meeting was called to order at 6:40 p.m. PLEDGE OF ALLEGIANCE ROLL CALL Present: Mayor Kathy Chiaverotti, Aldermen Madden, Kubacki, Engelhardt, DiPronio, Borgman, Hammel and Wolfe. STATEMENT OF PUBLIC NOTICE The meeting was noticed in accordance with the open meetings laws on November 21, 2014. APPROVAL OF AGENDA APPROVAL OF MINUTES Alderman Madden made a motion to approve the minutes of November 11, 2014, Alderman Borgman seconded. Motion Passed 7 in favor. NEW BUSINESS UNFINISHED BUSINESS Continued discussion of Fireworks Ordinance Alderman DiPronio requested that section 3(b), which describes individuals who may pull a permit, be made more specific than stating property owner. The word "Muskego" was recommended to be added prior to the word "property owner." Alderman DiPronio also pointed out the need for additional information on what designates a "pyrotechnic professional" to the language of the ordinance in 3(a), and felt that the insurance language was missing from the individual's clause of the ordinance. Discussion over what the City could require from individuals revealed that if the city is to be named under an umbrella liability policy, insurance companies will not offer such a policy to their clients. It was agreed that policy coverage does not prevent someone from filing suit against the city in the incidence of damage or injury, but a bond or being named in an umbrella liability policy provides coverage for the City for legal defense. Alderman Hammel further stated that requiring the same language for individuals would be a de facto ban on fireworks, as insurance companies are not likely to issue the type of insurance or bond the City would require. Alderman DiPronio remained opposed to any changes to the ordinance that didn't include the requirement of insurance from individuals. Mayor Chiaverotti read a statement from Police Chief Moser, which stated that the changes to the ordinance were a step in the right direction, but he would prefer not to submit any document or ordinance that allows personal use of fireworks. The ordinance as then approved will be sent to the City Attorney Larsen and should be on the January 13, 2015 Common Council agenda. Alderman DiPronio also requested that the attorney review what can be stated in the ordinance regarding individual insurance requirements. Alderman Hammel questioned the language for the fireworks calendar, asking if the length of the permit should be increased to four days. However, Mayor Chiaverotti stated that the three- day period with the addition of a Saturday date for years when the 3-day period falls during the week was enough, and any further accommodation fell beyond the role of government. Alderman Kubacki made a motion to approve the changes to the proposed ordinance, with the addition of language to define "pyrotechnic professional" and adding "Muskego" before "property owner" under 9.03 (3)(b). Alderman Hammel seconded. Motion Passed 7 in favor.
