Subject: Discuss on street parking issue at and near the intersection of Fennimore
Lane and Hale Park Drive

Alderman Wolfe has received several complaints regarding the appearance of the
areas of parking directly adjacent to the roadways in front of the two-family homes
near Fennimore Lane and Hale Park Drive. The condition of the roadside areas has
been affected by the constant on street parking pushing further and further off the
edge of pavement. Gravel has been placed in certain areas by a party other than the
City to accommodate street parking. The pictures below show the problem area.

An onsite meeting was held to discuss options such as restricting parking or asking
the owners to provide additional off street parking options. We investigated the
potential for additional off street options and found that most properties are already
at their maximum allowable impervious surfaces, so that option is not viable. By
adding additional no parking areas the problem will most likely be pushed to areas
further from this area or infringe upon areas that don’t need parking restrictions.
We also discussed the possibility of adding on street parking at the cost of the
adjacent homeowners. This would me a reconstruction that would add storm sewer
and curb and gutter that would allow for painted parking spaces completely off the
street. This alternative would cost approximately $15,000-20,000 per property for
construction. If this alternative was chosen, the project would need to be budgeted
as a capital improvement in a future year even if 100% of the project costs would be
assessed.
Recommendation for Action by Committee:
Discuss issue further and make a recommendation for staff to proceed with.

Dear Property Owner,
The City of Muskego has received complaints regarding on street parking causing damage to
City owned ditches in front of and/or near your property. The Public Works Committee met to
discuss this situation and voted to give all property owners a chance to rectify this situation
before the City steps in to resolve the problem which will most likely be an expense to all
property owners.
Many areas in front of or near your property have added stone to the ditch areas to the point that
vehicles are parking completely into the ditches (see photos on the back of this letter). The
Committee asks that you propose repairs to the ditches and a solution that will keep on street
parking to a minimum so that this maintenance problem does not reoccur.
The Public Works Committee will be discussing this issue again at its October meeting so please
communicate your intentions to resolve this issue via email to dsimpson@cityofmuskego.org
prior to that meeting or please attend the meeting to be part of the discussion.

Mr Simpson,
My apologies for the delay in providing my opinion regarding the street parking on Hale Park and Fennimore
streets.
I am an owner occupant in the area and yes at times the street looks like a parking lot. A couple ideas to resolve
this situation are switching sides or parking permits. However there are times when you should be able to park
in the street without a permit ie driveway maintenance then a phone call to police department. My family has a
duplex in Greendale. There are areas where overnight parking requires a permit or a call. If the permit is the
way then the cost should cover the administration and, if possible, cover some potential street repair.
Please know I did drive areound part the subdivision and there are other areas that the owners of the homes are
parking in the same fashion this is not just an issue on these two streets.

Thank you for your clarification in regards to the letter I received regarding the on street parking issues.
After receiving the letter, I went to the property I own (S70W13431‐33 Fennimore Ln) to speak with the tenants
regarding the parking and to inspect the ditch in front of my property. Here is what I was able to find out:
The ditch in front of my property is quite steep and it doesn’t appear that anyone is parking there on a regular
basis.
The tenants I have all park on the driveway. I know this must be true because while having the conversation, the
tenants began to argue with each other about not being able to get in and out based on where each of them are
parking on the driveway. (that was fun!)
I do need to be able to park on the street when spaces aren’t available in the driveway while working at the property
and think that some street parking should be available. Perhaps, no parking signs on one side of the street might be an
option if you don’t get cooperation from all the property owners and tenants.
I understand the issue but don’t believe that I should have to pay for the repairs to the ditches.

I just received the letter about the parking issues on Fennimore Lane. We own the duplex at S70
W13390/13392 Fennimore.
Years ago, when we still lived there, we had our driveway widened so everyone that lived there, as
well as guests, had a place to park on the property. We paid for the permit and the concrete work to
be done just so there wouldn't be issues or a need for street parking.
Obviously, we don't know what about the other owners and what they are doing for their tenants'
parking. But for us to offer off-street parking was a good idea and it seemed to help make that part of
the street less congested.

Subject: Discuss traffic issues in Rosewood Estates Subdivision

The Homeowner’s Associations for Rosewood Estates Subdivision and Candlewood
Village Condominiums have approached the City with concerns regarding excessive
traffic traveling through their subdivisions. They believe that traffic is traveling on
Rosewood Drive and Westcot Drive as a cut through between Moorland Road and
Durham Place. Their assertion is that traffic that would otherwise have utilized
Durham Place onto Janesville Road is cutting through their subdivision (as well as
using Cornell Drive to Tess Corners Drive). The Police Department completed
traffic counts in this area but the traffic counter appears to have malfunctioned as
the counts we not consistent so we will be completing further monitoring and can
report back at a future meeting.
Residents are requesting that the City consider alternatives as I have described and
discussed below and have shown on the attached map:
1. Reopen Durham Place onto Janesville Road. This alternative would be very
costly because the County would require the roadway to be realigned and
signals to be installed. The rough estimate of cost would be $500,000.
2. Connect Cornell Circle to Princeton Drive (Penn Lane). An existing right of
way that connects Cornell Circle to Princeton Drive could be improved with
a roadway to allow traffic to utilize the existing traffic signals at Princeton
and Janesville. This would require construction of approximately 400 linear
feet of roadway. This cost for this project would be approximately $50,000.
3. Install Traffic Calming along Rosewood Drive. Cost would vary for this
alternative but it would reduce any potential speeding and may deter cut
through traffic. The cost to install a traffic circle at Rosewood and Westcot
would be approximately $10,000-18,000. We have not utilized this
alternative in the past but this intersection may be a good candidate for this
type of project.
4. Close the roadway at the existing culdesac on Westcot. This option would
isolate the neighborhood by limiting emergency response as well as require
added operating expenses for snow removal, refuse collection, mail delivery.
The added capital expense for this option would be approximately $20,000
and is not favored by staff.
Recommendation for Action by Committee:
Discuss all options and direct staff toward next step.

Subject: Discuss Milwaukee County’s proposed alternative intersection design at Hi
View Drive and North Cape Road.
Date: October 20, 2014
Milwaukee County is working with the City of Franklin to reconstruct North Cape
Road from Hi View Drive to the north. As part of this process they are looking at a
possible reconfiguration of the intersection of Hi View Drive and North Cape Road.
Right now the intersection is dangerous because of the odd intersection alignment.
The County has asked that Muskego weigh in on the proposed alternatives that are
shown on the attached.
We have met at staff level and feel that Alternative #1 would create the safest and
most cost effective solution. Also, it should be noted that there is a small section of
roadway that is currently Waukesha County’s jurisdiction and there is a chance
that Waukesha County may at some point ask that the City of Muskego take
jurisdiction of that small section.
Recommendation for Action by Committee:
Approve Alternative #1 as the conceptual design that the City would most like to see
implemented by Franklin and Milwaukee County.

This technical memorandum will detail the comparison of four alternatives for the S. North Cape
Road and Hi-View Drive Intersection:CTH J and Hi-View–Do Nothing Alternative (EX 0.0),CTH J
and Hi-View–Eyebrow (EX 1.0), CTH J and Hi-View–Intersection (EX 2.0),and the CTH J and Hi-
View–Roundabout (EX 3.0).This comparison will list the impacts on access and safety,created
by each alternative.
Alternative #0 –Do Nothing Alternative –CTH J and Hi-View–Intersection (EX 0.0)
The Do Nothing Alternative would leave the existing intersection “as-is.” Minor pavement and
drainage modifications may be required to connect the existing intersection to the reconstructed S.
North Cape Road, but no changes to geometry of the roadway or intersection would be done.
Alternative #1 –CTH J and Hi-View–Eyebrow (EX 1.0)
This alternative includes the closing of S. North Cape Road from the intersection with Hi-View
Drive STA 1+20± to STA 4+10±.An eyebrow will be constructed at the south end of S. North
Cape Road to allow vehicles to turn around.There will be a connecting road, within Milwaukee
County right-of-way, from the eyebrow on S. North Cape Road to W. Forest Home Avenue. The
intersection of the connecting road with W. Forest Home Avenue will be approximately 320 feet
north of Hi-View Drive.An access drive will be constructed within the right-of-way,for entrance to
the property at W124 S8061 S. North Cape Road.The intersection of Hi-View Drive, W. Jefferson
Terrace,and W. Forest Home Avenue (CTH OO) will remain as a four way intersection.
Alternative #2 –CTH J and Hi-View–Intersection (EX 2.0)
In this alternative, the intersection of S. North Cape Road and Hi-View Drive will be cut off from W.
Forest Home Avenue,leaving a three-way intersection at the current location of W. Jefferson
Terrace and W. Forest Home Avenue.A connecting road, from S. North Cape Road to W. Forest
Home Avenue, will be constructed approximately 320 feet north of Hi-View Drive (on Milwaukee

County right-of-way), creating separate three-way intersections at S. North Cape Road and W.
Forest Home Avenue.
Alternative #3 –CTH J and Hi-View–Roundabout (EX 3.0)
This alternative includes construction of a roundabout at the intersection of S. North Cape Road,
Hi-View Drive,W. Jefferson Terrace and W. Forest Home Avenue. The roundabout will include
two lanes and will have five entrance and exit legs for each of the leg of the existing intersection.
Alternatives Analysis
The existing intersection of S. North Cape Road and Hi-View Drive is actually a separate
intersection from the intersection of Hi-View Drive/W. Jefferson Terrace and W. Forest Home
Avenue.However, because the intersections are so close to each other, they operate as a single
5-way intersection. The north and south legs of W. Forest Home Avenue have no traffic control.
All other legs are stop controlled. The stop sign on Hi-View Drive for W. Forest Home Avenue is
past the intersection with S. North Cape Road, creating a significant conflict point.S. North Cape
Road intersects with Hi-View Drive at an approximate right angle (the desired configuration), but
varies significantly from that desired angle as intersecting with W. Forest Home Avenue.Since
the intersection operates as a single entity, traffic on northbound W. Forest Home Avenue, turning
onto S. North Cape Road has a significant “skew” where the vehicles are actually making a left
turn and an immediate right turn.
Alternative #0, the Do Nothing Alternative, will maintain access;however it does not resolve any of
the safety issues that exist at the intersection.
Alternative #1 resolves all conflicts which currently exist.Removal of the S. North Cape Road leg
form the 5-way intersection allows the proposed 4-way intersection to operate in a more
conventional manner.The intersection of the new access road with W. Forest Home Avenue is
approximately at a right angle and is at sufficient distance from the existing intersection to
eliminate traffic conflicts.Direct access between S. North Cape Road and Hi-View Drive would be
eliminated and drivers would have to use W. Forest Home Avenue to get from one street to the
other. Driveway access will be maintained to all residences, with only minor modifications.
Alternative #2 also resolves all current conflicts. Removal of the intersection of Hi-View Drive and
W. Forest Home Avenue eliminates the conflict points created by the 5-way intersection; creating a
conventional 3-way intersection between W. Forest Home Avenue and W Jefferson Terrace and
standard bend in the road between Hi-View Drive and S. North Cape Road.The new access road
is in the same location and geometry as Alternative #1 and therefore has similar impacts on
conflict resolution.Direct access between W. Forest Home Avenue and Hi-View Drive would be
eliminated. Drivers would have to access S. North Cape Road to get from one street to the other.
Driveway access will be maintained to all residents.The 90° bend may cause some confusion for
drivers turning from eastbound Hi-View Drive to S. North Cape Road, because of the proximity to
W. Forest Home Avenue. Eastbound drivers on Hi-View Drive may see the through traffic on W.
Forest Home Avenue,believe they are approaching an intersection,and could attempt to continue
through to W. Forest Home Avenue. This may be more prevalent during nighttime conditions
when only headlights are visible.A barrier with a glare screen may be needed.This alternative
also creates an undesirable traffic pattern for drivers going between Hi-View Drive and W. Forest
Home Avenue because they would be routed around the intersection using the connecting road
and S. North Cape Road.

In Alternative #3 a roundabout could be designed to resolve all intersection conflicts, however, the
geometry of such a roundabout would have a large footprint and likely require right-of-way
acquisition. This alternative would also create access issues for westernmost driveway on W.
Jefferson Terrace because the driveway would be in the exit leg of the roundabout.
Conclusion
Alternative #0 does not address the safety concerns at the intersection and Alternative #3 has
right-of-way and driveway conflicts, therefore these alternatives are not recommended.
Alternatives #1 and #2 both address the safety concerns with the intersection and are viable
alternatives. However, Alternative #1 has a more driver friendly layout that would be less
confusing to drivers that are not familiar with the area. The close proximity of the 90 degree bend
at Hi-View / North Cape and the Jefferson Terrace / Forest Home intersection in Alternative #2
could be confusing particularly at night when headlights are visible.Therefore, we recommend
Alternative #1.
I hope this preliminary study on the S. North Cape Road (CTH J)/Hi-View Drive intersection will
help the Cities of Muskego and Franklin and the Counties of Milwaukee and Waukesha to evaluate
and ultimately choose an alternative to move forward with.If you have any questions, please feel

As part of the Development of the vacant lot at the north end of Commerce Drive,
the Developers are asking for a vacation of a portion of the north end of the cul -de-
sac. Commerce Drive was originally platted and installed as we see it today
unknowing of what future development may take place in this area. In order to
realize the full development potential of this lot the developers are proposing to pull
the cul-de-sac back to the south. Doing so will allow the building to keep a 60,000
square foot footprint and have more symmetry on the lot. Public Works Committee
recommendation of approval to allow the road vacation is sought and staff
recommends approval. The road vacation process requires steps in front of
Planning Commission and Common Council before actual adoption.
The Developer of this lot will be responsible for all costs associated with the right of
way vacation and roadway construction through a Development Agreement that
will come to Common Council for approvals.
A map showing the parcel to be sold and the area of the road vacation are attached.

Subject: Discuss proposed sale of a portion of Moorland Road water tower property

The City Council recently approved various incentives for a new 60,000 square foot
business structure to be built on the northerly lot in the Moorland Commerce
Center West along Commerce Drive and abutting Moorland Road.
A 102 square foot piece of land is requested to be purchased from the City of
Muskego (see attached). This piece of land is found on the southeast corner of the
current water tower property in the Commerce Center. After consultation from the
City’s Engineering consultant related to water towers we have found that this piece
of land is not required to be owned by the City for the future maintenance of the
water tower. An easement will be required to ensure we have enough room for
future painting and maintenance but the parcel portion itself is not needed.
Staff recommends approval to the Council to sell this piece of land for the future
development.
Recommendation for Action by Committee:
Recommend approval of the sale of 102 square feet of the Moorland Road water
tower parcel.

The petitioner’s goal is to vacate Wauer Lane which is found within the Waste Management lands along
Crowbar Drive. The right-of-way served the development back when the waste site was open to the
public. Wauer Lane is now not required and will aid Waste Management in cleaning up property boundary
lines for this area in the future.
DISCUSSION PC 051-2014
Relating to the right-of-way vacation, all of the proper documents have been submitted to proceed with
the right-of-way request. The request is also proceeding through the Public Works Committee for their
review. There are no expected major concerns with this right-of-way vacation request. With the vacation,
each tax key parcel abutting the vacated right of way gets half of the adjacent right-of-way back as part of
their lot. The Planning and Engineering Divisions do not see any major problems with the requested
vacation. As such, staff is recommending approval of the right-of-way vacation, subject to any pending
Engineering comments.

to Western Termination

Some residents along Ryan Road have come to ask the City to consider renaming
Ryan Road to Ryan Drive based on the fact that a street sign at the corner of Ryan
Road and North Cape Road was incorrectly showing Ryan Drive as the name for
many years.
After residents requested this I sent letters to all owners on Ryan Road asking that
they provide an opinion for the name of the roadway (see attached). I received 17
votes requesting that the name be changed to Ryan Drive and 2 votes requesting
that it stay Ryan Road.
Recommendation for Action by Committee:
Based on the resident’s requests recommend changing the street name to Ryan
Drive from North Cape Road to the western terminus.

Official Street Name- Ryan Drive vs. Ryan Road
Dear Property Owner,
It was recently brought to our attention that the street name sign indicating the name of the
roadway that your property is addressed off of was changed. The street name signs had
previously indicated that your street name was Ryan Drive and the street name signs have now
been changed to Ryan Road.
The official name of the street west of North Cape Road is currently Ryan Road, however, there
has been interest in changing your official street name to Ryan Drive because that is what some
residents have used as their address for many years. The City can accommodate this type of
request if the majority of property owners affected wish to have the name officially changed.

Subject: Proposed changes to Municipal Code section 28.04(17) for cross
connection inspections and 28.05(4) for regulation of private wells
when connected to municipal water

The City’s Water Utility is required to meet certain requirements enacted by State
Administrative Codes. In order to comply with WDNR requirements we must make
some changes to our Municipal Code that regulates the water utility and implement
a cross connection inspection program of all properties connected to the City’s
water system.
The code changes must be completed by the end of the year and we must begi n cross
connection inspections in 2015. Cross connection inspections can be completed by
City staff when completing meter changes on residential facilities, however,
inspections must be completed every two years for high hazard properties. High
hazard inspections must be completed by trained professionals that deal with this
type of inspection on a regular basis. I recommend hiring a firm to complete the
inspections over the next two years with costs being billed to the property owners.
The required code changes that are being required by the WDNR as well as the
proposed “Cross Connection Control Policy Manual” are attached for your review
and potential approval.

well at the Cross Connection Control Policy Manual
28.04 (17) PURITY OF SUPPLY NOT TO BE IMPAIRED BY CROSS CONNECTIONS
(b) UNPROTECTED CROSS CONNECTIONS PROHIBITED. No person, firm, or
corporation may establish or maintain, or permit to be established or maintained, any
unprotected cross connection. Cross connections shall be protected as required in
chapters NR810 and COMM 82SPS 382, Wisconsin Administrative Code.
(c) INSPECTION. The water utility may inspect, or arrange for an inspection of,
property served by the public water system for cross connections. At its sole discretion, the
water utility may require a person, firm, or corporation who owns, leases, or occupies
property to have their plumbing inspected, at their own expense by a State of Wisconsin
Certified Cross Connection Inspector. The frequency of inspections shall be established by
the water utility in accordance with Wisconsin Administrative Code. Inspections will be
conducted for every residential and low hazard non-residential service a minimum of once
every ten years or on a schedule matching meter replacement. Public educational
materials, when being provided in lieu of low hazard inspections, shall be provided to the
customer no less than every 3 years and with every cross connection inspection. Unless
otherwise approved by the Utility and the WDNR, the Utility shall cause an inspection to be
conducted for every high hazard services a minimum of once every 2 years. Any
unprotected cross connections identified by the inspection shall be promptly corrected.
Failure to promptly correct an unprotected cross connection shall be sufficient cause for the
water utility to discontinue water service to the property, as provided under 28.04(17)(f) of
this ordinance.
28.04 (4) USE OF PRIVATE WELLS UPON CONNECTION TO MUNICIPAL WATER SERVICE
(e) Permanent Abandonment Procedure. (Ord. #786 - 3-18-93) Owner intending to
permanently abandon well will notify the Utility of the date of the intended
abandonment. Persons intending to abandon a well shall pay a $30 registration
fee to the Building Inspection Department, fill out a registration form and DNR
Form #3300-5W and/or any other similar or replacement forms that may be in
use from time to time. The DNR form or forms shall be completed and properly
filed and a copy of said completed form filed with the City of Muskego Building
Inspection Department within 30 days of receipt of said form. Failure to return
the completed DNR form or forms to the Building Inspection Department within
the time required will result in the well not being abandoned. The Utility will be
permitted to fully inspect the entire process of abandonment. Owner will comply
with NR 112.26812, Wisconsin Administrative Code. In the event the Owner of a
private well that has tested unsafe or has failed to obtain well permit refuses or
neglects to permanently abandon said well on or before September 1 of each
year, the Utility or its agents or contractors may, without notice, enter upon
Owner's property and permanently seal said well in accordance with NR
112.26812, Wisconsin Administrative Code, and the cost thereof shall be
presented to the City Treasurer who shall place said amount on the tax roll as a
special charge pursuant to State Statute 566.60 (16), Wisconsin Statutes. Any
person who shall attempt to abandon said well without having first notified the
Utility shall be subject to the requirement of furnishing the Utility proof of property
compliance with NR 112.26812, Wisconsin Administrative Code. In the event
owner is unable to furnish satisfactory proof to the Utility that said well was
properly abandoned under said Administrative Code provision, the Utility shall
have the right to enter upon the property and perform all necessary tasks to

verify that the abandonment of said well was done under the Administrative Code
procedure and specifications. Any and all costs incurred by the Utility in
permanently sealing said well shall be presented to the City Treasurer who shall
place said amount on the tax roll as a special charge pursuant to State Statute
566.60(16), Wisconsin Statutes. Any future additions, amendments, revisions or
modifications of the current NR 112.26812, Wisconsin Administrative Code, or
future successors to said section, are also incorporated herein by reference.

Cross Connection Control Policy Manual
For the control of CROSS CONNECTIONS and BACKFLOW PREVENTION
1. General Policy
Purpose The purpose of this manual is:
To supplement Municipal Code 28.04(17), “PURITY OF SUPPLY NOT TO BE IMPAIRED BY CROSS
CONNECTIONS”. These regulations are in place to protect the health and welfare of users of the public potable water
supply of the City of Muskego.
To promote for the control and/or elimination of existing cross connections (actual or potential) between the
customer’s potable water system(s) and other environment(s) containing substance(s) which may contaminate or
pollute the water supply.
To provide for the maintenance of a continuing Comprehensive Program of Cross Connection Control which will
systematically and effectively prevent the contamination or pollution of all potable water system(s) under the direct
authority of the City Water Utility.
Definitions
a. Backflow; The undesirable flow of water or mixtures of water and other liquids, solids, gases or other
substances under positive or reduced pressure into the City of Muskego Water System potable supply of
water from any source.
b. Backflow Prevention; A means designed to prevent backflow caused by backpressure or backsiphonage;
most commonly categorized as air gap, reduced pressure principle backflow assembly, double check
valve assembly, pressure vacuum breaker assembly, backsiphonage backflow vacuum breaker (spill
resistant pressure vacuum breaker) assembly, pipe applied atmospheric vacuum breaker, flush tank
ballcock, laboratory faucet backflow preventer, backflow preventer for carbonated beverage machine,
vacuum breaker wall hydrants, (freeze resistant automatic draining type), chemical dispensing machine,
hose connection vacuum breaker, hose connection backflow preventer, backflow preventer with
intermediate atmospheric vent, barometric loop, or similar.
c. Backpressure; An elevation of pressure in the downstream piping system (i.e. Pump, elevation of piping,
or steam and/or air pressure) above the Utility supply pressure, which would cause or tend a reversal of
the normal direction of flow.
d. Backsiphonage; The flow of water or other liquids, mixtures or substances into the utility’s potable
water system from any source caused by the sudden reduction of pressure in the utility’s potable water
supply system.
e. Cross Connection; Any physical connection or arrangement between two otherwise separate systems,
one of which contains potable water from the utility, and the other containing water from a private
source, water of unknown or questionable safety, or steam, gases or chemicals, whereby there may be a

flow from one system to the other, the direction of flow depending on the pressure differential between
the two systems.
f. Cross Connection Control Ordinance; An Ordinance written to give the Utility legal authority for
enforcement of state and local regulations related to water system protection for all water customers
g. Cross Connection Control Manual; Policies and procedures for cross connection control and backflow
prevention for the City of Muskego, Wisconsin. More specific measures and procedures, day-to-day
operations, cost, surveys, regulations, etc are included.
h. “Degree of Hazard” Determinations:
1) High Hazard: Health Hazard – May cause illness or death if ingested…toxic or contaminant
2) Low Hazard: Non-Health Hazard – May cause unpleasant appearance, taste, or odor of water…non-
toxic and considered as a pollutant
2. Cross Connection Prohibited: No person shall establish or permit to be established or maintain or permit to be
maintained any cross connection. No interconnection shall be established whereby potable water from a
private, auxiliary or emergency water supply, other than the public water supply of the utility, unless such
private, auxiliary or emergency water supply and the method of connection and use of such supply have
been approved by the Utility and the Wisconsin Department of Natural Resources.
3. City Responsibility: The City of Muskego Water Utility shall be responsible for the protection of the public potable
water distribution system from contamination or pollution due to backflow of contaminants or pollutants.
4. Owner Responsibility: The property owner shall be responsible for the protection of the customer’s potable water
system. The responsibilities include the elimination of or protection from all cross connections on their
premises. The owner shall, at their own expense, install, maintain, test, and submit proof of compliance for
any and all backflow preventers on their premises in compliance with the Department of Safety and
Professional Services (DSPS) Chapter SPS 382 requirements and the Utility’s Municipal Code and the Utility’s
“Cross Connection Control Policy Manual”. The property owner shall have corrected any malfunction
revealed by periodic testing of any backflow preventer on their premises. Annual test results shall be filed
with the DSPS for all testable assemblies other than Double Check Assemblies (DC) and Double Check
Detector Assemblies (DCDA) which test results shall remain on the assembly and copies shall be forwarded
to the Utility upon request. The property owner shall inform the Utility of any proposed or modified cross
connections and also any existing cross connections that are not protected by an approved backflow
prevention means.
The property owner shall not install a by-pass around any backflow preventer unless there is a backflow
preventer of the same type in the by-pass. Property owners who cannot shut down operation for testing of
the backflow prevention assembly must supply additional assemblies necessary to allow testing and
maintenance to take place. In the event the property owner installs potable water using fixtures, equipment
or appurtenances upstream of a backflow preventer, such must have its own approved backflow prevention
means.
The property owner is required to follow the protection practices described in (but not exclusive to) the
American Water Works Association publication AWWA M-14 titled “Recommended Backflow Prevention and
Cross Connection Control”, United States Environmental Protection Agency publication titled “Cross
Connection Control Policy Manual”, Wisconsin DSPS Plumbing Code, SPS 382-384, the Utility’s “Program for
protecting public water system”, and the Utility’s “Cross Connection Control Policy Manual” unless the Utility

requires or authorizes other means of protecting the potable water supply system. These requirements or
authorizations will be at the discretion of the Utility.
5. Inspections: It shall be the duty of the Utility to cause surveys to be made of all properties serviced by the Utility
where cross connections with the public water system is deemed possible. An initial 2-year inspection phase
will determine high and low hazard sites. Residential and low hazard non-residential properties serviced by
the Utility shall be inspected during routine water meter change-outs, on average every 10-20 years. All high
hazard properties serviced by the utility shall be inspected on an interval not exceeding 2 years. The
frequency of required inspections and reinspections, based upon the potential health hazards, may be
shortened by the Utility. All sites will receive a copy of the inspection results after the inspection. Non-
compliant sites will receive a notification to comply and must do so within the time frame shown on the
notification. The Utility may, but is not required to, perform the cross connection inspection of the
customer’s property. Responsibility and cost for the inspection will fall upon the water customer. If, in the
opinion of the Utility, the Utility is not able to perform the inspection, the property owner must, at their
own expense, have the water system piping inspected for cross connections by a person who has been
properly trained in accordance with the American Society of Sanitary Engineers (ASSE) Standard number
5120, been educated by the University of Wisconsin School of Engineering, USC certified, University of
Florida TREEO certified, or similar, as a Cross Connection Control Surveyor or Inspector.
6. Right of Entry: Upon presentation of credentials, a representative of the water utility shall have the right to request
entry, at any reasonable time, to a property served by a connection to the public water system for the
purpose of inspecting the property for cross connections. Refusing entry to such utility representative shall
be sufficient cause for the water utility to discontinue water service to the property, as provided under
28.04(17)(f) of this ordinance. If entry is refused, a special inspection warrant under Section 66.0119 of the
Wisconsin Statutes, may be obtained.
7. Authority to Discontinue Service: The water utility may discontinue water service to any property wherein any
unprotected connection in violation of this ordinance exists, and take other precautionary measures
deemed necessary to eliminate any danger of contamination of the public water system. Water service may
be discontinued, however, only after reasonable notice and opportunity for hearing under Chapter 68,
Wisconsin Statutes, except as provided in 28.04(17)(g) of this ordinance. Water service to such property
shall not be restored until the unprotected cross connection has been eliminated.
8. Reconnection of Service: Water service to any property disconnected under provisions of this policy shall not be
restored until the cross connection(s) has been eliminated or a backflow prevention means approved by the
Utility has been installed in compliance with the provisions of this section. A re-connection fee per the
Utility’s rate schedule will be charged.
9. Emergency Discontinuance of Service: If it is determined by the water utility that an unprotected cross connection or
emergency endangers public health, safety, or welfare, and requires immediate action, and if a written
finding to that effect is filed with the City Clerk and delivered to the customer's premises, water service may
be immediately discontinued. The customer shall have an opportunity for hearing under Chapter 68,
Wisconsin Statutes, within 10 days of such emergency discontinuance. Water service to such property shall
not be restored until the unprotected cross connection has been eliminated.

10. Additional Protection: In the case of premises having (a) cross connections that cannot be permanently corrected or
controlled, or (b) intricate plumbing and piping arrangements or where entry to all portions of the premises
is not readily accessible for surveying purposes, making it impractical or impossible to ascertain whether or
not dangerous cross connections exist, the public water supply system shall be protected in the service line.
In the case of any premises where there is any material dangerous to health that is handled in such a
manner that, in the opinion of the Utility, could create an actual or potential hazard to the public water
supply system, an approved air gap separation or an approved reduced pressure principle backflow
assembly shall protect the public water supply system. In the case of any presence of toxic substances, the
utility may require an approved air gap or reduced pressure principle backflow assembly at the service
connection to protect the public water supply system. This requirement will be at the discretion of the
Utility.
