CITY OF MUSKEGO Staff Report to Public Works Committee To: Public Works Committee From: David Simpson, P.E., Director of Public Works/City Engineer Subject: Request by Lynn Kurer to purchase City owned land at the corner of Schultz Lane and Durham Drive Date: April 14, 2014 The City of Muskego received the attached request to purchase City owned land at the corner of Schultz Lane and Durham Drive. The request was made by the adjoining land owner, Lynn Kurer. The land, which is shown on the attached map, is approximately 10,100 square feet in size and is not currently being utilized by the City and I see no potential future use for the land. It appears that the land was purchased by the City in order to realign Schultz Drive with Durham Drive in the past. The City purchased land from the adjoining parcel in conjunction with the Durham Drive reconstruction project in 2011. At that time we completed a detailed appraisal and valued the land at $14,000 per acre. I discussed this with the City Assessor and she believes this is a reasonable price as well. If the property were 10,100 square feet, the purchase price would be $3,246. I believe that we should also ask that the buyer pay for the completion of a certified survey map by a surveyor of her choice, any legal fees, and also any title reports needed. Recommendation for Action by Committee: Approve potential sale contingent upon owner agreeing to purchase price of $14,000 per acre plus survey, title report, and legal costs. April 7, 2014 To: Public Works Committee From: Craig Anderson, Parks & Recreation Director RE: AT&T Easement AT&T has contacted the City of Muskego for an easement along the southerly 6’ edge of the property line of the parks headquarters building (W180 S7732 Pioneer Drive) for the purpose of installing high speed internet/U-verse off Pioneer Drive. AT&T will do direct bore underneath our asphalt area within the 6’ wide easement and is responsible for any restoration required. They are also responsible for the payment for the city attorney review of easement language. With so many residents requesting options for their cable/internet provider, we feel this easement should be granted. Community Development Director Jeff Muenkel has said that if this land were to ever go up for sale, the easement in this area of the parcel would have no negative effects on land values. Recommendation for Action by Committee: NB#3-Review request for placement of a sign within a vision corner for S75 W17308 Janesville Road- I have reviewed the request and recommend that the Committee approve the placement of the sign as requested as I see no potential safety concerns. NB#4-Review request for placement of a sign within a vision corner for S76 W17655 Janesville Road- I have reviewed the request and recommend that the Committee approve the placement of the sign as requested as I see to potential safety concerns. NB#5- 5.Review request for placement of a fence within a vision corner at W184 S7735 Kelly Drive. I have reviewed the request and recommend not approving the request as submitted as I see potential safety concerns if the fence were installed as requested. I do recommend reducing the vision corner to 12 feet on the Kelly Drive right of way and 48 feet on the Janesville Road right of way as depicted on the attached. Vision Setback Area variations may be allowed if found by the Public Works Committee that a proposed development does not impede safety at both the present and future time. Vision corners vary depending on the two adjoining roadways and their widths. In any case, a vision corner is usually limited in the height of structures or plantings that can occur in them so as to not affect the vision of a driver when pulling up to a corner. Tonight we have three requests to allow structures in vision corners that abut the newly constructed Janesville Road. Each structure proposed usually wouldn’t have been allowed in the vision corner previous to the reconstruction. However the requests now have merit for approval since the reconstruction has produced much larger viewing angles for drivers in the area since the Janesville Road has been widened and has separated lanes with boulevards. Request #1: Muskego Liquor – S75 W17308 Janesville Road Muskego Liquor has been left with very limited room for a monument sign on their property post-reconstruction of Janesville Road. One area that doesn’t affect their parking and access is the SE corner of their lot within the vision corner of Center Drive and Janesville Road. The request is to be able to put a sign in this area. The sign would meet normal Muskego sign codes of no more than 7 feet tall at the property line. Due to the reconstruction a driver on Center Drive cannot turn left when approaching Janesville Road since a boulevard now cuts this access off. Thus the need to look to the west is limited to watching for pedestrian traffic. Where a driver would pull up to the Center Drive stop sign there is now clear view both east and west anyway as a sign would be well behind the sidewalk and terraces of this area anyway as well. Approval is recommended. Request #2: Associated Bank – S76 W17655 Janesville Road Like Muskego Liquor, Associated Bank has been left with very limited room for a monument sign on their property post-reconstruction of Janesville Road. At this event each year the association presents awards to those in the public water treatment & conservation industries that have shown excellence in areas of utility management, operations and customer service. One of these areas is workplace safety, and the winner of the 2014 WRWA Safety Award was Muskego, WI. “Working in the public utility industries is a dangerous occupation, especially in the weather conditions we experience here in Wisconsin” said WRWA Executive Director Dave Lawrence, “We’re honored to recognize communities like Muskego that are committed to maintaining a safe workplace for all their municipal employees while at the same time providing excellent services to their customers.” The Wisconsin Rural Water Association is a non-profit organization representing most of the water and wastewater systems in the state. Its mission: “To assist our membership and the public they serve, improve and preserve the quality & quantity of water resources in the State of Wisconsin”.
