PLEDGE OF ALLEGIANCE Those present recited the Pledge of Allegiance. ROLL CALL Present: Alderperson Madden, Alderperson Borgman, Scott Kroeger, Director of Public Works and Development, Scott Kloskowski, Utility Supervisor Absent: Alderperson Hammel Guests: Rick Burback, Jared Burback, Bill Carity, Steve of Joe DeBelak Plumbing, Gloria Basse STATEMENT OF PUBLIC NOTICE The meeting was posted in accordance with open meeting laws. APPROVAL OF MINUTES Alderperson Madden made a motion to approve the minutes of April 15, 2019 meeting. Alderperson Borgman seconded. Motion Passed 2 in favor. STATUS OF PROJECTS Discussion update. No formal action may be taken on any of the following: Waukesha Water Director Kroeger stated no updates from last meeting. Bay Lane Reconstruction Director Kroeger stated the project is set to begin May 28th and continue through October 15, 2019. The City has put information regarding the road construction out on all social media available and has been in contact with Bay Lane Elementary. On May 21st, door hangers will be placed on those homes directly affected by the construction. Between May 28th and June 14th, the road will be partially closed to accommodate the end of the school year. After June 14th, the road will be closed completely, except for those residing in the area or to reach the ball diamonds. After the plans are updated, another Public Information Meeting will be held in June or July at the City Hall. UNFINISHED BUSINESS Discussion update and possible action may be taken on any or all of the following: Water Main Assessments – Defer to June Meeting Director Kroeger stated the water study is almost completed. The findings will be presented to the Committee of the Whole first in July/August, followed by a presentation to the Public Works Committee. NEW BUSINESS Discussion update and possible action may be taken on any or all of the following: Muskego Lakes Estates – Public Improvements Director Kroeger stated this 27 lot development will have public water, roads, sanitary and storm. These plans should be approved with contingency for staff to deal with any future problems should they arise during construction. Alderperson Madden made a motion to approve the Muskego Lakes Estates Public Improvements. Alderperson Borgman seconded. Motion Passed 2 in favor. Will Rose – Public Improvements Director Kroeger stated this project includes two large apartment building that will have public water and sanitary. Due to the project being located on Janesville Road, some approvals were through Waukesha County. These plans should be approved with contingency for staff to deal with problems should they arise during construction. Alderperson Madden made a motion to approve the Will Rose Public Improvements. Alderperson Borgman seconded. Motion Passed 2 in favor. Nike Missile Site – S70W20279 Adrian Drive Director Kroeger reviewed his attached memo and map with the Committee. Alderperson Madden made a motion to approve the requested driveway easement for proposed parcel two of the Nike Missile Site area through proposed parcel one. Alderperson Borgman seconded. Motion Passed 2 in favor. Will Rose – Internal Water Service Director Kroeger began by reading through the yellow highlighted area of his attached memo. He continued by reviewing the remainder of his memo for the Committee stating why the City was against the waiver requesting only one meter be installed. (Parkland Towne Center, currently under construction, used individual meters.) Bill Carity and Steve both referenced Page 2 of 3 Approval of Minutes of the May 20, 2019 Meeting Packet Page 3 their attached email as to why they believe the City should grant a waiver for one meter. Discussion continued from both parties with pros and cons. Mr. Carity then asked the Committee to defer the waiver request until next month. Director Kroeger suggested Mr. Carity do some additional research in the four county area regarding one meter vs multi meters, and come back next month to convince the Committee to grant the waiver. Utility Supervisor Kloskowski agreed if the Committee does grant the waiver next month, then the City would need to move forward in changing its own Ordinance. Alderperson Madden made a motion to defer this until June to gather more information. Alderperson Borgman seconded. Motion Passed 2 in favor. The section highlighted in yellow is the area in question by Will Rose. City of Muskego – Chapter 355 Water, 355-4 Establishment of Service § 355-4Establishment of service. A. Customers to be subject to Public Service Commission rules. All persons who may hereafter receive water from the Water Utility or who may hereafter make application therefor shall be considered as having agreed to be bound by rules and regulations as filed with the Public Service Commission of Wisconsin. B. Application. Application for water service shall be made in writing on a form furnished by the Public Works and Safety Committee. The application shall contain a legal description of the property to be served, including tax key number, name of applicant, use to be made of service and such other information as the Utility may require. C. Conditions for service. Service shall be furnished only if: (1) Applicant has installed or agrees to install a service pipe from the water main in the street to the point of use laid not less than six feet below the surface of an established or proposed grade and according to the Utility's specifications; (2) Applicant pays required hookup charge; (3) Premises have adequate piping beyond metering point; and (4) Applicant shall pay any water capacity assessment which the City shall deem reasonable and necessary. D. Multiunit metering. Multiunit dwellings shall be served by individual metered water service to each unit, except by approval of the City of Muskego. The owner shall provide interior plumbing and meter settings to enable individual metered service to each unit and individual disconnection without affecting service to other units. Each meter and meter connection shall be a separate Water Utility customer for the purpose of the filed rules and regulations. The owner is responsible for and subject to § 355-3of this chapter.[Amended 9-19-1996 by Ord. No. 903] E. Division of water service prohibited. No division of the water service of any lot or parcel of land shall be made for extension and independent meterage of the supply to an adjoining lot or parcel of land. No division of a water supply service shall be made at the curb for separate supplies therefrom for two or more separate premises having frontage on any street or public service strip whether owned by the same or different parties. The Committee is hereby empowered to withhold approval of any application wherein full information of the purpose of such supply is not clearly set forth by the applicant property owner. This ordinance was established for several reasons:  Water can be shut off to an individual apartment and not affect all the residents in the building.  Individual water meters promote water conservation practices. Each individual is charged only for the water they use. An individual who uses less daily water is not penalized by a person who would use more. The PSC promotes water conservation practices.  Usually all the water meters are placed in an individual room located outside of any residents place. This allows for work to be done on the meters without any inconvenience to the residences of the building. Parkland Town Center is the most recent multifamily apartment building to be constructed/being constructed in the City of Muskego. The two 30-unit buildings both have individual water meters for each unit. The Will Rose Development would be consistent with the Parkland Town Center apartments. Will Rose development have provided three rationals why they are opposed to this ordinance and would like to be considered for a variance. I have attached their document for you to review. Recommendation for Action by the Committee: City staff recommends the committee to follow the ordinance in place. The City of Muskego is being consistent with following the ordinance and treating all developers the same. This ordinance has been in place since 1996 in the City of Muskego. If the plumber had any questions about design standards, the plumber should have reviewed the City Ordinances and/or reached out to City Staff before starting and completing the entire design. Not designing it to City standards and asking for a variance after the fact due to construction schedule is not a reasonable request. 1. A Central Hot Water system does not provide any type of water conservation for the City of Muskego. 2. The City of Muskego would need the PSC to sign off on a 3rd party water metering system. A 3rd party water metering system would be acting as a water utility and would need sign off from the PSC. Furthermore, technology has made it quite easy for the City to read meters and send out bills. 3. Multiunit buildings are constructed all the time with individual meters, as in the case of the Parklawn Town Center. A catastrophic failure is unlikely with current Page 2 of 7 Will Rose - Internal Water Service Packet Page 6 construction practices. This rational is not providing a benefit to the City of Muskego. Page 3 of 7 Will Rose - Internal Water Service Packet Page 7 1 Hi Scott, Please schedule myself, representing the Basse family, before your Public Works Committee Meeting on May 20th to review the City's requirement for individual water meters as it applies to the first phase (51 units) of the Basse PRD. We desire to commence construction in June and had not designed the plumbing for individual meters. Our plumbing contractor was unaware of the City's requirement for individual meters as this requirement is unusual in the greater Milwaukee market place. Our petition for one single house meter (to be located in the lower level) carries the following rational: 1. The majority of the water consumption for multifamily residents is hot water for daily showers. The Basse Family desires to be protective of the City's water resource and to that end they have been considering a Central Hot Water system which is more efficient to energize than 51 individual hot water heaters. There is no way to separately meter individual units with this type of central system thereby defeating the purpose of individual meters which means that it pushes the project into individual hot water tanks - far less efficient & expensive to renters. 2. If the Basse Family decides not to go with the Central Hot water system an option could be to install a 3rd party water metering system. This system is monitored at each unit remotely by a 3rd party and billed to the tenant - instilling a willingness to conserve water. These systems are common in multifamily housing and would save the City the cost and labor of sending out 51 individual bills. 3. The installation of individual meters will require an additional 8,000 feet of water supply and return line (1.5 Miles) for the first building including multiple fittings and bends which is far more likely to experience future catastrophic failure than one simple supply line to the 51 units - this is a 3 story building. Myself and our plumber (Joe DeBelak Plumbing and Heating) looks forward to discussing the above together with any other options at the Meeting next Monday. In the PSC’s opinion, a private company managing individual resident would not constitute a water public utility.  The City of Muskego did some further investigation on how this variance from the ordinance would affect the Water Capacity Assessment (WCA) for the City of Muskego. The City of Muskego did an estimate on the WCA charges for this development based on our ordinance and on the requested variance (refer to attached document). The approximate differences are the following: The WCA charge would go from about $87,000 to $46,000. In addition, quarterly charges would go from about $1,800 to $300. Recommendation for Action by the Committee: City staff recommends the committee to follow the ordinance in place. The City of Muskego is being consistent with following the ordinance and treating all developers the same. This ordinance has been in place since 1996 in the City of Muskego. Both of these roads are consider residential roads with maximum widths of 20 feet and not arterials or collector roads. The speed limit for both roads is 25 mph. Additionally Muskego Drive has speed bumps to help with traffic calming. Traffic Accident Data from the last 5 years: Muskego Drive Single Vehicle vs pole = 2 Unsafe backing up =1 Fail to obey sign =1 Hit and Runs = 5 No Fatalities Jewel Crest Drive Single Vehicle in ditch (OWI related) = 1 Unsafe backing up =1 No Fatalities Manual on Uniform Traffic Control Devices (MUTCD) standards: Chapter 3B. Pavement and Curb Markings 10 Center line markings should be placed on paved urban arterials and collectors that have a traveled way of 20 feet or more in width and an ADT of 4,000 vehicles per day or greater. Center line markings should also be placed on all rural arterials and collectors that have a traveled way of 18 feet or more in width and an ADT of 3,000 vehicles per day or greater. Center line markings should also be placed on other traveled ways where an engineering study indicates such a need. Recommendation for Action by the Committee: City staff recommends that double yellow centerlines not be placed along these two roads. There is not a justification that deems these roads to be different than other residential roads in the City of Muskego. These roads do not meet any MUTCD standards requiring centerline. Packet Page 12 This would set a precedent that other residents would request that their residential streets would request a double yellow centerline as well. The City of Muskego DPW budgets and staff time do not account for painting or maintaining double yellow centerlines on residential/neighborhood streets. Furthermore, a double yellow centerline would mean that there is no passing allowed on these roads. Therefore, it would be illegal for any cars to cross a double yellow line.
