CALL TO ORDER
Alderperson Madden called the meeting to order at 5:00 PM.
PLEDGE OF ALLEGIANCE
Those present recited the Pledge of Allegiance.
ROLL CALL
Present: Alderperson Madden, Alderperson Engelhardt, Alderperson Borgman, and Scott
Kroeger, Director of Public Works and Development
STATEMENT OF PUBLIC NOTICE
The meeting was posted in accordance with open meeting laws.
APPROVAL OF MINUTES
Alderperson Borgman made a motion to approve the minutes of March 11, 2019
meeting. Alderperson Engelhardt seconded.
Motion Passed 3 in favor.
STATUS OF PROJECTS
Discussion update. No formal action may be taken on any of the following:
Waukesha Water
Director Kroeger stated we are waiting for 90% plans to be provided to the City for review.
Bay Lane Reconstruction
Director Kroeger stated last week Tuesday, Common Council approved the water contract for
Wilkomm Excavating. The preconstruction meeting was held last week Thursday. We are
currently waiting for our DNR permit before work can begin.
We currently have two bids we are reviewing for the road construction portion of this project.
After that has been officially awarded, we will hold a pre-con meeting and begin the road work.
Hillendale Reconstruction
Director Kroeger stated another PIM (public information meeting) will be held this summer in
which residents will have a chance to see the plans without the trail included.

Parking around Lions Park
Director Kroeger stated he is presenting this topic on behalf of Chief Rens. He handed out a
map in reference to the Chief’s Memo about where exactly parking would be allowed/not
allowed around Lions Park. The Chief is requesting this idea as a permanent solution for the
area.
Alderperson Engelhardt made a motion to approve the suggested parking layout around
Lions Park. Alderperson Borgman seconded.
Motion Passed 3 in favor.
The Waters of Lake Denoon
Director Kroeger stated this is a 15 lot subdivision that will have public roads, storm sewer and
sanitary sewer, but private wells. These plans should be approved with a contingency for staff
to deal with problems found at the time of construction.
Alderperson Borgman made a motion to approve The Waters of Lake Denoon.
Alderperson Madden seconded.
Motion Passed 3 in favor.

Staff Report to Public Works and Safety Committee

Subject: Watermain Assessments
Date: September 17, 2018
The City of Muskego took over four private water services built in the middle or late 1970s.
The areas of concerns include Lake Lore (2000s), Lake Brittany (2000s), Guersey Meadows
(1980s), and Kristin Downs (1990s) subdivisions. The City of Muskego did not charge a
hook up fee or charge to put these homes in the WCA (Water Capacity Assessment).
These systems are made out of ductile iron and have reached their life expectancy. These
areas have consistently been the City of Muskego’s highest areas of water main repairs.
The estimated cost to design and construct brand new watermains for these 4 areas is
approximately $8.5 million.
The watermain will not be replaced until they are in the area of the road program. The
City of Muskego will continue to make repairs as needed.
For the Baylane road project we have a small portion of watermain (approximately 1,000
feet) to be replaced. Since we are digging up Baylane road for this project this is the time to
do this work. Therefore, the City of Muskego needs to put a policy in place on how to
handle these costs so we are consistent moving forward.
Recommendation for Action by the Committee:
I am looking for a policy recommendation from the Committee.

The City of Muskego has reviewed Muskego Lakes Estates plan set (please refer to the
latest plan set attached dated 5-1-19). The road, storm sewer, water and sanitary sewer will
be dedicated to the City of Muskego upon completion and acceptance of the project. The
City of Muskego has reviewed the plans and given approval for these plans to move
forward contingent upon all City of Muskego staff comments being addressed.
Recommendation for Action by the Committee:
Approve the road, storm sewer, water and sanitary sewer design plans for Muskego Lakes
Estates, contingent upon all City of Muskego staff comments being addressed.

The developer (Mike Michalski) plans to purchase the existing 13.97 acre property from the
original property owner Mr. Jorgen May.
The first step plan is to divide off 1.13 acres from the 13.97 acre parcel and add it to Mr.
Jorgen May’s current property. Please refer to the map and this area outline in a green
color. This will allow Mr. May to keep the existing accessory building that he currently
uses for storage and plans to continue to do so.
The remaining parcel will be a 12.84 acre parcel with access from Adrian Dr. on the north
side of the parcel. Mr. Michalski plans on subdividing this remaining parcel into two a 2
acre parcel and 10.84 acre parcel. Both parcels meet the requirements of the current RS-1
suburban residence zoned.
Mr. Michalski is asking for a waiver from the city’s ordinance 392-35 Land Division
General Standards B.
“Improvements to be extended to farthest limit of parcel or lot. Any and all improvements,
streets, or utility services required by this chapter, for the subdivision, certified survey
map, or condominium plat, shall be extended to the farthest limit of the parcel or lot as set
forth on the plans and specifications approved by the City. If determined by the Plan
Commission, based on the information of engineering staff, that a resulting development
will cause increased effects on existing infrastructure, the cost of all reasonably necessary
improvements on the exterior of a development, such as expanded roadways, intersections,
and/or utility extensions, shall be paid by the developer/owner.”
The developer is asking that the 2 acre parcel be granted access by means of an easement
through the 10.84 acre parcel instead of a direct access to the existing public ROW located
in front of the parcel. The 2 acre parcel meets all other land division requirements,
including having property frontage along a dedicated right-of-way. The 10.84 parcel meets
all requirements and does not need a waiver.

Recommendation for Action by the Committee:
The City of Muskego staff recommends this waiver for the following reasons:
The existing row in front of the proposed 2 acre parcel contains Al Schroeder’s
driveway. The City of Muskego would not recommend for the developer to
upgrade this driveway to public road standards approximately 150 feet so this
parcel will have direct access to a public road. The City of Muskego is aware that is
unlikely for the land behind the Schroeder’s property to be developed due to
existing conservation area and environmental concerns.
The City of Muskego would be responsible for long-term maintenance of this
approximately 150 feet of public roadway. This would not be cost beneficial to the
City of Muskego for one new parcel.

Dear Mr. Kroeger:
The intent of this letter is to pursue approvals for a land division for the property located at S70
W20279 Adrian Dr.
The existing parcel is a 13.97 acre property with an accessory building from the original use of
the property, a Nike missile site. The missile site was decommissioned in 1963 and the current
owner uses the building for storage.
The current owner, Jorgen May, lives next door to the parcel at S70 W20177 Adrian Dr. Mr
May intends to divide off 1.13 acres from the 13.97 acre parcel and add it to his current
property. This will allow Mr May to keep the accessory building for storage.
The remaining parcel will be a 12.84 acre parcel with access from the North end of the parcel
on Adrian Dr.
I intend to purchase the property from Mr May and subdivide the property into a 2 acre parcel
and a 10.84 acre parcel, on which I would like to build a single family house.
The parcel is currently zoned RS‐1 Suburban Residence which requires the following:
‐ 30,000 sf minimum lot size
‐ 120 lf minimum lot width
‐ 20,000 sf open space minimum
‐ 40’ front setback and 20’ side setbacks
‐ 1,100 sf minimum dwelling size
‐ 80’ frontage on Right of Way
The proposed parcel meets all of these requirements, however, it will not have direct access to
the existing Cul de Sac. This can be accomplished by granting an easement and sharing a
driveway with the larger parcel.
Per our discussions, this solution is being utilized in other areas of Muskego. It also avoids the
extension of a roadway with no additional benefit to any of the surrounding neighbors.
Lastly, this property is going to take a huge commitment of resources because of the missile
bunkers that will need to be demolished as well as all the concrete and asphalt that need to be
removed. I am committed to restoring the property to a natural area. Extending the road for no
real benefit, will put this project out of reach.

Subject: Will Rose – Water service metering for multiunit buildings

The City of Muskego’s ordinance is below concerning water service metering for
multiunit buildings. The section highlighted in yellow is the area in question by Will
Rose.
City of Muskego – Chapter 355 Water, 355-4 Establishment of Service
§ 355-4Establishment of service.
A. Customers to be subject to Public Service Commission rules. All persons who may
hereafter receive water from the Water Utility or who may hereafter make application
therefor shall be considered as having agreed to be bound by rules and regulations as
filed with the Public Service Commission of Wisconsin.
B. Application. Application for water service shall be made in writing on a form
furnished by the Public Works and Safety Committee. The application shall contain a
legal description of the property to be served, including tax key number, name of
applicant, use to be made of service and such other information as the Utility may
require.
C. Conditions for service. Service shall be furnished only if:
(1) Applicant has installed or agrees to install a service pipe from the water main in the
street to the point of use laid not less than six feet below the surface of an established or
proposed grade and according to the Utility's specifications;
(2) Applicant pays required hookup charge;
(3) Premises have adequate piping beyond metering point; and
(4) Applicant shall pay any water capacity assessment which the City shall deem
reasonable and necessary.
D. Multiunit metering. Multiunit dwellings shall be served by individual metered water
service to each unit, except by approval of the City of Muskego. The owner shall
provide interior plumbing and meter settings to enable individual metered service to
each unit and individual disconnection without affecting service to other units. Each
meter and meter connection shall be a separate Water Utility customer for the purpose
of the filed rules and regulations. The owner is responsible for and subject to § 355-3of
this chapter.[Amended 9-19-1996 by Ord. No. 903]
E. Division of water service prohibited. No division of the water service of any lot or
parcel of land shall be made for extension and independent meterage of the supply to an
adjoining lot or parcel of land. No division of a water supply service shall be made at
the curb for separate supplies therefrom for two or more separate premises having
frontage on any street or public service strip whether owned by the same or different
parties.

F. Approval may be withheld. The Committee is hereby empowered to withhold
approval of any application wherein full information of the purpose of such supply is
not clearly set forth by the applicant property owner.
This ordinance was established for several reasons:
Water can be shut off to an individual apartment and not affect all the residents
in the building.
Individual water meters promote water conservation practices. Each individual
is charged only for the water they use. An individual who uses less daily water is
not penalized by a person who would use more. The PSC promotes water
conservation practices.
Usually all the water meters are placed in an individual room located outside of
any residents place. This allows for work to be done on the meters without any
inconvenience to the residences of the building.
Parkland Town Center is the most recent multifamily apartment building to be
constructed/being constructed in the City of Muskego. The two 30-unit buildings both
have individual water meters for each unit. The Will Rose Development would be
consistent with the Parkland Town Center apartments.
Will Rose development have provided three rationals why they are opposed to this
ordinance and would like to be considered for a variance. I have attached their document
for you to review.
Recommendation for Action by the Committee:
City staff recommends the committee to follow the ordinance in place. The City of
Muskego is being consistent with following the ordinance and treating all developers the
same.
This ordinance has been in place since 1996 in the City of Muskego. If the plumber had
any questions about design standards, the plumber should have reviewed the City
Ordinances and/or reached out to City Staff before starting and completing the entire
design. Not designing it to City standards and asking for a variance after the fact due to
construction schedule is not a reasonable request.
1. A Central Hot Water system does not provide any type of water conservation for the
City of Muskego.
2. The City of Muskego would need the PSC to sign off on a 3rd party water metering
system. A 3rd party water metering system would be acting as a water utility and
would need sign off from the PSC. Furthermore, technology has made it quite easy
for the City to read meters and send out bills.
3. Multiunit buildings are constructed all the time with individual meters, as in the
case of the Parklawn Town Center. A catastrophic failure is unlikely with current

construction practices. This rational is not providing a benefit to the City of
Muskego.

Hi Scott,
Please schedule myself, representing the Basse family, before your Public Works Committee Meeting
on May 20th to review the City's requirement for individual water meters as it applies to the first phase
(51 units) of the Basse PRD. We desire to commence construction in June and had not designed the
plumbing for individual meters. Our plumbing contractor was unaware of the City's requirement for
individual meters as this requirement is unusual in the greater Milwaukee market place. Our petition
for one single house meter (to be located in the lower level) carries the following rational:
1. The majority of the water consumption for multifamily residents is hot water for daily showers. The
Basse Family desires to be protective of the City's water resource and to that end they have been
considering a Central Hot Water system which is more efficient to energize than 51 individual hot
water heaters. There is no way to separately meter individual units with this type of central system
thereby defeating the purpose of individual meters which means that it pushes the project into
individual hot water tanks - far less efficient & expensive to renters.
2. If the Basse Family decides not to go with the Central Hot water system an option could be to
install a 3rd party water metering system. This system is monitored at each unit remotely by a 3rd
party and billed to the tenant - instilling a willingness to conserve water. These systems are common
in multifamily housing and would save the City the cost and labor of sending out 51 individual bills.
3. The installation of individual meters will require an additional 8,000 feet of water supply and return
line (1.5 Miles) for the first building including multiple fittings and bends which is far more likely to
experience future catastrophic failure than one simple supply line to the 51 units - this is a 3 story
building.
Myself and our plumber (Joe DeBelak Plumbing and Heating) looks forward to discussing the above
together with any other options at the Meeting next Monday. Thanks and please send me any staff
recommendations and the agenda prior to the meeting.
