Mayor Chiaverotti called the meeting to order at 6:01 p.m.
PLEDGE OF ALLEGIANCE
Those present recited the Pledge of Allegiance.

Mustapich and Library Director Larson. Absent: Alderperson Kapusta.
STATEMENT OF PUBLIC NOTICE
The meeting was noticed in accordance with the open meeting law.
PUBLIC HEARING
To hear any citizen on the proposed 2019 City Budget.
Mayor Chiaverotti declared the hearing open.
Ms. Mustapich reviewed highlights of the proposed 2019 budget with the use of a Power Point
presentation. The presentation provided a summary of the General Operating, Debt Service,
Special Revenue and Capital Budget outcomes achieved through a cooperative approach
which comprise a team including the Mayor, Committee of the Whole and key staff members.
The final Committee of the Whole budget meeting was held October 9, 2018. Certain
adjustments to the General Operating Budget were recommended to offset the updated State
revenue funding decrease.
The proposed tax levy is $13,364,447. Of that total, $10.7 million will fund expenditures for
basic operations in the General Fund, $2.1 million will be dedicated for Principle and Interest
payments and $548,000 will be applied towards the active Tax District Increments.
As for the City Tax Rate, recent State Levy Limit mandates included a new reduction to the
allowable increase for Personal Property Aid. Although net new construction amounted to a
2.045% increase, the City was restricted to a 1.65% levy limit due to the newly implemented
adjustment. For 2019, the City will utilize 1.585%, which resulted in an estimated City Tax
Rate of $4.50 per $1,000.00 of assessed value; this reflects a nine cent increase from the prior
year.
Ms. Mustapich next reviewed the Debt Service Fund, which is used to account for the principle
and interest payments on all General Obligation debt. Funding sources include property taxes,
tax increment financing, conservation fund reimbursement and interest earnings. For the
current year, the City’s total principle balance outstanding is $46 million, leaving a debt
capacity limit of $110 million or 70.43%. The recent Debt Refunding will support the current

Facility Projects and two major upcoming road improvement projects. Future borrowing plans
and debt levy projections continue to indicate minimal increases.
Special Revenue Funds, otherwise known as Specific Purpose Programs, were reviewed next.
The expenditure activities for 2019 resulted in a projected grand total for all funds combined of
approximately $5.3 million, which is up by $1.1 million as compared to the prior year. The
majority of this increase is due to the Landfill funding for the Tess Corners Volunteer Fire
Department Capital Equipment purchases.
Finally, the 2019 Capital Budgets were reviewed, which are proposed at $10.8 million. The
major items to be financed by $8.5 million of General Obligation Debt include the Bay Lane
Reconstruction Project and continuation of the construction phases for the Police Department
facility. The remaining items will be funded by $2.3 million of Landfill Host Fees and consist of
various equipment requests from the Finance, Information Technology, Library, Public Safety
and Public Works Departments.
The 2019 Budget Public Hearing Presentation was concluded. It was noted that all proposed
budgets will be considered at the October 23, 2018 Common Council meeting.
The Muskego Senior Taxi Director, Karin Nickel, was present. She thanked the Council for its
continued support. She outlined the need for the taxi service in the community for both the
elderly and young adults with disabilities.
Several young adults and their parents spoke in favor of the service.

TO DEPOSIT AND FORFEITURE SCHEDULE
WHEREAS, The City Attorney has reviewed the City’s Deposit Forfeiture Schedule and
has recommended some revisions in consultation with various Department Heads and
Staff; and
WHEREAS, The Finance Committee has reviewed the proposed changes and
recommends approval to the Common Council.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego, in accordance with Chapter 18-3 of the Municipal Code, and as approved by
the Municipal Judge, does hereby approve the following amendments to the Deposit
and Forfeiture Schedule as attached.

Belle Chasse Partners LLC entered into a Development Agreement with the City to
construct certain improvements in and for Belle Chasse Subdivision Addition #2 and
#3. These improvements include, but are not limited to, sanitary sewer, water main,
storm sewer, roadway construction and grading. The work has been completed and
the punch list items addressed, and the Developer is now asking for final release of
the Letter of Credit.
I have reviewed the request and I am recommending final release of the Letter of
Credit balance of $2,500.00.
Recommendation for Action by Committee:
Recommend final release of the Letter of Credit for the Belle Chasse Subdivision
Addition #2 and #3.

Original Memo to Public Work and Safety Committee – October 16, 2018
As part of the Bay Lane Drive Reconstruction project, the plan is to connect Bellview Drive
to Bay Lane Drive. Currently, Bellview Drive does not connect with Bay Lane Drive
however there is not an existing cul de sac at the end of Bellview Drive. The right of the
way exists for this connection and was always planned to be connected. This is the most
cost effective time to make this connection with the reconstruction of Bay Lane Drive.
Since there is not a cul de sac at the end of Bellview Drive, it makes it very difficult for
emergency vehicles, garbage trucks, snowplowing or utility work to operate in this area.
Large trucks need to either back up or turn around by impeding on a private driveway.
Furthermore, Bay Lane Drive tends to get congested during drop off and pick off at Bay
Lane School and an additional access point would be beneficial for emergency vehicles
traveling along Bay Lane Drive.
The City of Muskego’s policy is to encourage connectivity with every development through
the City. This current design would not be acceptable to new development. Attached is the
plat for the subdivision indicating a future connection from Bellview Drive (South Hillview
Drive) to a future road. The plat indicates no right of way set aside for a cul de sac bulb or
a tee turn around.
Additional Questions asked at Committee:
Q. What is the City doing about the increased traffic on Bay Lane Drive due to the
increased school population?
A. The Public Works and Development Director, Police, Consultant and School District
met to go over new traffic flow at the school. Furthermore, a bypass lane is part of the road
project to allow for better traffic flow on Bay Lane Drive thereby avoiding the
bottlenecking currently transpiring.
Q. Why is Bellview Drive being discussed at this time for connecting to Bay Lane Drive?
A. The City has planned for the connection since 1954 as noted in on plat and the City owns
the right of way for this purpose. This is the appropriate and cost effective time to make the
connection when reconstructing the road. The consultant needs the City’s direction to
finish the design.
Q. What is the Fire Chief’s input or concerns on opening or permanently closing off
Bellview Drive to Bay Lane Drive?
A. Phil Dibbs “The Fire Department preference is to have Bellview Drive connect to Bay
Lane Drive.”

A. There could be more traffic but incorporating a bypass lane at the school should move

A. Yes, per the City Attorney.

Background Information:
As the Common Council has previously authorized, the City is going through the process to list the former
Parks Garage for sale since it is no longer in use by the City. As part of this sale, the City wanted to rezone
the property so that a new potential user will know the basic allowed uses and so that the current
government/institutional uses will not be the only uses allowed into the future.
The proposed rezoning applies to the PI-1 zoned portion of the property (Tax Key Number 2196.976). The
rezoning is from PI-1 – Park & Recreation Lands to B-3 – General Business District for the purpose of
allowing future commercial uses in/on the former Parks Garage building/site. The 2020 Comprehensive

DISCUSSION PC 057-2018
The City is petitioning for a rezoning for the former Parks Garage property. The request includes
rezoning of all of the PI-1 portion of Tax Key Number 2196.976. The 2020 Comprehensive Plan needs to
also be modified as part of this request from Institutional uses to Commercial uses (for all of Tax Key Nos.
2196.976 & 2196.988).
A public hearing for this request was held on October 23, 2018. There was one question raised at the
public hearing relating to what types of uses would be allowed in the proposed zoning district. Staff
talked with the neighbors that had questions after the public hearing and explained the general uses
allowed in the B-3 district. One further question related to if multi-family would be allowed and it was
explained that the B-3 district does not allow multi-family uses.
It was also explained that any new business user of the site would need to apply for a business
registration and would most likely need Plan Commission approval for the use of the site.

SECTION 263-22,
OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO
(Disposal of abandoned or Unclaimed Personal Property)
THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN DO ORDAIN
AS FOLLOWS:
SECTION 1: Chapter 263, Section 263-22, of the Municipal Code of the City of
Muskego is hereby amended to read as follows:
263-22. DISPOSAL OF ABANDONED OR UNCLAIMED PERSONAL PROPERTY.
A. The City may dispose of any personal property which has been abandoned or
remains unclaimed for a period of 30 days after the taking of possession of the
property by City officials by any means determined to be in the best interest of
the City.
(1) Disposal of personal property shall be in a manner prescribed by the
Common Council or those listed below:
(a) Public auction.
(b) Sealed bids. Said advertisement of sealed bids shall be in a manner
prescribed by the appropriate department head.
(c) Destruction.
(d) Return to rightful owner.
(e) Transfer to appropriate governmental entity.
(f) Holding of a public sale by a nonprofit organization and the payment to
said organization of a reasonable commission from the sale proceeds with
the balance being paid to the City.
(g) Return to the person(s) who turned the item in to the Police Department if
requested and no rightful owner can be located.
(h) Public sale through Internet-based sales, i.e., E-Bay or Property
Room.com.

(2) These procedures presume that if the personal property to be disposed of
appears to be or is reported stolen, an attempt will be made to return said
property to the rightful owner.

B. If the property is not disposed of by the City itself in a sale open to the public, the
City shall maintain an inventory of such property, a record of the date and
method of disposal, including the consideration received for the property, if any,
and the name and address of the person taking possession of the property. Such
inventory shall be kept as a public record for a period of not less than two years
from the date of disposal of the property.
A. Custodian. The Chief of Police or designee shall be the custodian of all personal
property that has been lost, abandoned, or picked up during the course of a
police investigation. The Chief of Police or designee having custody of the
property shall attempt to return the property to the rightful owner.
B. The Chief of Police or designee may, pursuant to Wis. Stats. §66.0139, dispose
of any such property abandoned or unclaimed for a period of 30 days, by any of
the following means, as determined by the Chief of Police or designee to be in
the best interest of the City:
(1) The property may be sold at public auction, including an internet auction
service contracting with the City.
(2) The property may be sold without a public auction at a sale open to the
public, including internet-based sales such as eBay.
(3) The property may be sold in a private sale through an agreed-upon
amount of sale.
(4) The property may be retained by the City for its own use.
(5) The property may be donated.
(6) The property may be destroyed or discarded as trash, recycled, or sold as
scrap.
(7) The property may be used in trade on other property to be acquired.
(8) The property may be sold, traded, or transferred to an outside publicly
funded agency.
C. Firearms. Any seized firearm, ammunition or dangerous weapon shall not be
returned to any person who committed a crime involving the use of the seized
item. Seized property that is a firearm, ammunition, or dangerous weapon may
be returned to the rightful owner under this section if the owner had no prior
knowledge of and gave no consent to the commission of the crime. Firearms,
ammunition, or dangerous weapons which are abandoned or remain unclaimed
for a period of 30 days shall be returned to the rightful owner, destroyed, or
transferred to the State Crime Laboratory established under §165.75, Wis. Stats.

D. Seized Property. If property seized pursuant to a search warrant or seized
without a search warrant is not required for evidence or further investigative use,
and has not been disposed of pursuant to a court order, the custodian or their
designee shall make reasonable attempts to notify all persons who or may have
an authorized rightful interest in the seized item that they may apply for return of
the seized item pursuant to §968.20, Wis. Stats. Any item that has not been
applied for its return within 30 days of notice shall be considered abandoned or
unclaimed and disposed of pursuant to this section.
E. Record Keeping.
(1) Records of the sale or destruction of personal property shall be
maintained by the Chief of Police or their designee in whose custody the
personal property had been committed. The records shall include the
following information:
(a) Description of the property;
(b) The date of the sale or destruction;
(c) The method of disposal;
(d) Consideration received for the property, if any,
(e) If the property is sold or otherwise transferred, the name and
address of the person taking possession of the property.
(2) Such records shall be kept as public record for a period of not less than
two years from the date of the disposal of the property
F. Deposit into City Account. All money retained by the City as described in this
section, or that is found by a City official, employee, or agent that is unclaimed
and all proceeds of any sale of abandoned or unclaimed property shall be
deposited by the Director of Finance and Administration into the general account
of the City of Muskego.
G. Return of lost property to finder or owner. Sections 170.07 through 170.105, Wis.
Stats., as amended from time to time, are incorporated herein by reference. Any
decisions, determinations and certifications to be made by a law enforcement
agency under the aforesaid statutes shall be made by the Chief of Police or their
designee, upon such proof which may be deemed sufficient, in the sole discretion
of the Chief of Police or their designee, respectively.
H. Stolen Property. If the Custodian has property in their possession that appears to
be or is reported stolen they shall attempt to return the property to the rightful
owner before disposing of the property as allowed by this section.

SECTION 1: Chapter 263, Section 263-23, of the Municipal Code of the City of
Muskego is hereby amended to read as follows:
263-23. USE OF CIGARETTES, NICOTINE, AND TOBACCO, AND VAPOR
PRODUCTS RESTRICTED.
A. Definitions. As used in this section, the following terms shall have the meanings
indicated:
CIGARETTE
A narrow tube of cut tobacco enclosed in paper and designed for smoking.
NICOTINE PRODUCTS
A product that contains nicotine and is not any of the following:
(1) A tobacco product.
(2) A cigarette.
(3) A product that has been approved by the United States Food and Drug
Administration for sale as a smoking cessation product or for another medical
purpose and is being marketed and sold solely for such an approved purpose.
SCHOOLS
The public schools under the jurisdiction of the School Board of the City of
Muskego.
TOBACCO PRODUCTS
Cigars, cigarettes, cheroots, stogies, periques, smoking tobacco, tobacco in any
form, including but not limited to granulated, plug cut, crimp cut, ready-rolled, and
fine cut, chewing tobacco, snuff tobacco, shorts, refuse scraps, clippings,
cuttings and sweepings of tobacco, and any other kinds or forms of tobacco
prepared in a manner as to be suitable for chewing or smoking or both.

VAPOR PRODUCTS
“Vapor Products” shall mean noncombustible products, that may or may not
contain nicotine, that employ a mechanical heating element, battery, electronic
circuit or other mechanism, regardless of shape or size, that can be used to
produce a vapor in a solution or other form including but not limited to an
electronic cigarette, electronic cigar, electronic cigarillo, electronic pipe,
vaporizers, or similar products or devices. “Vapor products” shall include any
vapor cartridge, solution, or other container, that may or may not contain nicotine,
that is intended to be used with an electronic cigarette, electronic cigar, electronic
cigarillo, electronic pipe, vaporizer, or similar products or devices. “Vapor
products” do not include any products regulated by the United States Food and
Drug Administration under Chapter V of the Food, Drug, and Cosmetic Act.
B. Restriction on sale or gift of cigarettes, nicotine products, or tobacco products.
Section 134.66, Wis. Stats., as amended from time to time, is hereby adopted by
reference as though fully set forth herein.
C.Use of cigarettes, nicotine products, and tobacco products by children prohibited.
Section 254.92, Wis. Stats., as amended from time to time, is hereby adopted by
reference as though fully set forth herein.
D. Sale of vapor products to minors prohibited. No person, by himself, his servant or
agent, or as the servant or agent of any other person, shall sell, give away, or
otherwise dispose of, by vending machine or otherwise, any vapor products to any
person under the age of eighteen (18) years.
E. Purchase or possession of vapor products by person under 18 prohibited.
(1) No person under 18 years of age may falsely represent his or her age for the
purpose of receiving any vapor products.
(2) No person under 18 years of age may purchase, attempt to purchase, or
possess any vapor products except as follows:
(a)A person under 18 years of age may purchase or possess vapor products
for the sole purpose of resale in the course of employment during his or
her working hours if employed by a retailer. The defenses provided in Wis.
Stat. § 134.66(3)(a)-(c) shall also be defenses to any prosecution
hereunder.
C.F.Possession of cigarettes, nicotine products, and tobacco products, and vapor
products by students in school buildings or upon school property. No person enrolled
as a student in the Muskego-Norway School District may possess any cigarette,
nicotine product, or tobacco product, or vapor product at any time inside any building
or on any property owned, leased or used by a public school in the City.

D.G.Use of cigarettes, nicotine products, and tobacco products in school buildings or
upon school property. No person may smoke, light, ingest, chew, inhale, or

any property owned, leased, or used by a public school in the City.
