NOTICE OF CLOSED SESSION
PLEASE TAKE NOTICE that the Board of Appeals of the City of Muskego may convene, upon passage of the proper
motion, into closed session pursuant to Section 19.85(1)(a) of the State Statutes for the purpose of deliberating concerning
cases which were the subject of a quasi-judicial hearing; said cases being the appeals described below. The Board of
Appeals will then reconvene into open session.

1. APPEAL #01-2008
Petitioner: Ted & Nicole Kulwicki
Property: W182 S6578 Garnet Drive / Tax Key No. 2174.948.001
REQUESTING: Under the direction of Chapter 17 Zoning Ordinance: Section 3.02 Zoning Board of Appeals, Petitioner
seeks the following variance:
Chapter 17 - Zoning Ordinance: Section 5.10 – Engineering Regulations
(2)C. Building Restricted Adjacent to Drainage Channels or Watercourses: No building other than a bridge,
dam, boathouse, or revetment subject to the aforesaid approval, shall be erected, structurally altered
or relocated within 10 feet of the ordinary high water line of surface water, drainage channel or 20 feet
of the ordinary high water line of a natural watercourse nor so that the lowest floor of said building is
less than 2 feet above possible flood stage as determined by the Engineering/Building Inspection
Director.
Any building needs to have its lowest floor at least 2 feet above possible flood stage (100 year flood plain) per Chapter 17 –
Zoning Code. The petitioner seeks an elevation of 1 foot above the 100-year flood plain to permit the placement of a new
accessory structure (garage) on their property, and is therefore requesting a 1-foot elevation variance from the required
height above the 100-year flood plain.
