NOTICE OF CLOSED SESSION
PLEASE TAKE NOTICE that the Board of Appeals of the City of Muskego may convene, upon
passage of the proper motion, into closed session pursuant to Section 19.85 (1) (a) of the State
Statutes for the purpose of deliberating concerning cases which were the subject of a quasi-
judicial hearing; said cases being the above listed appeals.
The Board of Appeals will then reconvene into open session. Detailed descriptions are
available for public inspection at the Clerk's office. All interested parties will be given an
opportunity to be heard.

1. APPEAL #01-2005
Petitioner: Michael Binder
Residence: S69 W17735 Wildwood Drive / Tax Key No. 2176.072
REQUESTING: Under the direction of Chapter 17 Zoning Ordinance: Section 3.08(1)
Appeal Provisions, Petitioner seeks the following variances:
Chapter 17—Zoning Ordinance: Section 5.02 Building Location
(1) Location Restricted: No building shall be hereafter erected, structurally
altered or relocated on a lot except in conformity with the following
locational regulations as hereinafter specified for the district in which it is
located.
A setback of 37-feet is required from the front (northeast) property line. The petitioner seeks a
setback of 36.5-feet from the front property line to permit the continued construction of a new
home, and is therefore requesting a 0.5-foot variance from the front (northeast) property line.
Additionally an offset of 7.88-feet is required from the side (southeast) property line. The petitioner
seeks an offset of 7.4-feet from the side property line to permit the continued construction of a new
home, and is therefore requesting a 0.48-foot variance from the side (southeast) property line.

Appeal Provisions, Petitioner seeks the following variances:
Chapter 17—Zoning Ordinance: Section 5.08 Existing Substandard Lots
The open space requirements in the case of such lot may be reduced
without appeal provided the open area is equal to at least 75% of the actual
lot area.
The minimum open space required for the property is 4,341 square feet (75% of the 5,788 SF lot).
The current open space is 4,350 square feet, resulting in 75.2-percent of the lot area being
preserved as open space, which is conforming. The Appellant is proposing to pave a 590 SF
driveway, resulting in 65-percent of the lot area being preserved as open space, and is therefore
requesting an 10-percent variance to the Code requirement.
